SUBJECT: NPDES Administrative Draft Municipal Permit
The National Pollutant Discharge Elimination System (NPDES) Municipal Permit for San Diego
County regulates storm water and other discharges from urbanized areas of San Diego County.
The San Diego Regional Water Quality Control Board (Regional Board) is in the process of re-
issuing the current Municipal Permit per the requirements of the Clean Water Act. This
'memorandum is intended to provide an update on the progress to date and potential impacts of
the new permit on the City of Chula Vista.
The Regional Board adopted the current Municipal Permit on January 24, 2007 as Order No. R9-
2007-0001. The San Diego Municipal Permit regulates storm water and urban runoff discharges
from 21 jurisdictions of Svi Diego County (collectively known as the Copermittees) including
the County of San Diego, the San Diego Unified Port District, the San Diego County Kegional
Airport Authority, and 18 hrcorporated cities of San Diego County. The Clean Water Act
requires that NPDES Municipal Permits be reissued every five years. On April 9, 2012, the
Regional Board released 'an administrative draft of the new permit to seek informal public
comments and to receive input from stakeholders before the first draft of the new permit is
.finalized for formal public review and comment. The Regional Board intends to adopt the new
permit in the first quarter of 2013, with the implementation phase starting one year later.
On April 25, 2012, Regional Board staff organized an informal workshop in which they
explained their approach arrd methodology in drafting the new permit. They received oral
comments from workshop participants, and answered questions. A common theme for the
comments was regarding the contrast between the overly strict, costly, and often infeasible
lahguage in the Administrative Draft Permit with the flexibility and rationality presented by
Regional Board staff at the workshop. Later, 'to explain and reconcile this contrast, Regional
Board staff met with the Copermittees and expressed their willingness to take input from the
Copermittees and other stakeholders and revise.specific.pemrit language where appropriate and
feasible.

As an outcome of the above meeting, Regional Board staff and Copermittees agreed to set up
four focused meetings with participation from stakeholders including Copermittees, non-
governmental organizations, development industry, and the Environmental Protection Agency.
The focused meetings were held in June, July, and August, 2012. These meetings were
facilitated by a professional facilitator and each was dedicated to one chapter of the
Administrative Draft Permit. Only technical issues were discussed in these meetings. Attorneys
from various jurisdictions volunteered to form a legal team to review the Administrative Draft
Permit and compile a list of legal issues that should be discussed with Regional Board staff.
However, any discussions on legal issues were to be conducted in meetings separate from
technical focused meetings discussed above.
1n its current form, the Administrative Draft Permit includes significantly expanded monitoring
requirements that may increase overall monitoring costs by up to 1000 percent. It is estimated
that if the permit is adopted in its current form, the City of Chula Vista's annual monitoring cost,
which is currently about $175,000, may increase to about $2,800,000 for the first year of
implementation and to about $1,100,000 for subsequent years. Any non-compliance with
numeric standards may result in a violation of the new permit and subsequent fines or third party
lawsuits. Also, very strict requirements for the treatment and retention of storm water on
development projects will have significant fiscal impacts on public and private development
projects and may make some projects uneconomical or infeasible to construct.
During this period, Copermittee representatives conducted frequent internal meetings to identify
-and prioritize major issues to be discussed with the Regional Board and to develop strategies to
make the draft permit more effective, economical, and practical through discussions with
Regional Board staff and the subsequent formal public review and comment process. Through
the above meetings, the Copermittees developed joint comments and alternative permit language
that the County of San Diego as the Principal Permittee submitted to the Regional Board on
behalf of all the Copermittees on September 14, 2012. The City of Chula Vista and some other
Copermittees also submitted their individual comment letters. All comments received by the
Regional Board are available on their website at:

The Regional Board plans to issue a formal draft permit in November or December of this year,
taking into consideration input received during the focused meetings. A formal public review
and comment process will follow that will involve participation by the general public. The
Copermittees will have another chance to provide their specific comments and receive responses
from the Regional Board. Staff will provide further updates on the progress as necessary.

Ladies and Gentlemen:
I have come before the council today to bring your attention a lack of
commitment on the part of city personnel to find permanent solutions to problems which
have existed on ls` Avenue for many years. These problems are unique to the zero-
hundred (000) block of 1" Avenue. I have owned the property located at 89 ls` Avenue,
Chula Vista, CA, in excess of nine (9) yeazs.. The sewer and public works past attempts
to control the problems has not met with a satisfactorily, long-term conclusion.
I have written a lengthy statement with regards to my concerns. I would be very
appreciative if each council member would take the time to read my complaint prior to
hariding my letter and statement to a subordinate, departmental employee. I believe the
lack of knowledge on your part, collectively, and the decisions to expend funds for
permanent solutions can only be made by the collective council I am also requesting a
written response from the council member who oversees my district.

Good Afternoon.
I am Paula Seiberlich, and I am the property owner of the residence located
at 89 ls` Avenue in Chula Vista. I have owned this property for 9'/4 years.
Last week I had intended to come here and complain today about the never
ending "lack of service" that I receive from Allied Waste Services, and the
"not-so-service-oriented" Residential Customer Service Representative.
Over the years, I have had to have numerous, numerous contacts regarding
my trash, recycle and yard waste, and having to interact with the
"unreceptive" receptionist is just plain maddening.
When I thought about how to approach the council, what I realized is my
problem is not so much with. Allied Waste Services, but instead with all
greater the city services/personnel with which I've come into contact. You
see, I have a very different and somewhat off-the-beaten-path type property.
My residence is located within the city limits, on First Avenue, the last built
residence on the northern-most section of the street, the 00-hundred block.
Picture, in your mind, the intersection of D Street and 15` Avenue. That is
the end of the asphalt pavement. Now go north down a dirt path, carved
from the square footage of my neighbor's real estate parcel. One will dead
end at a city owned gate, which is supposed to impede travel on anon-public
strip of city-owned land. I own the adjoining 1.14 acres parcel of land with
2 houses on it.
First Avenue continues northbound beyond the gate with the city owning a
strip of land several hundred linear feet in length. To the right of the city
land, there are 5 privately held parcels of land north of me, unimproved for
the 9 years I have lived there -though these properties have passed to new
ownership multiple times. The reason the parcels remain unimproved is an
insistence by city personnel that a road be built and paved by the landowners
who hope to build a home on the lots. The prohibitive cost of a road makes
it impossible for anyone to improve their lots.

So herein is my dilemma. I am in the city limits, although I do not have the
level of services most of your constituents enjoy.
I do not have curbside trash service. I have no curb. Over the years as
supervision from Allied Waste and I have tried different ways to problem
solve my service, we have not been able to come to a permanent solution. In
the past, I had been accommodated with large trucks coming down the dirt
path, but only as long as I agreed to keep the city gate open on trash day so
that the trucks could proceed northbound to make a U-turn. What wound up
happening on Wednesday, my day for service, was that every manner of
vehicle rode down the city's property, against the posted signage. Some
dumped furniture, appliances, or household trash, while others just
trespassed on motorcycles, all terrain vehicles, or trucks.
My property is located at a low point of elevation. When the winter rains
come, the dirt path 1 rely upon receives both rain fall and a tremendous
amount of runoff water from the neighboring streets. The path becomes
eroded after the first good rain. It only erodes further as the winter rains
progress. The erosion has been 18" to 48" deep in areas and in the past I
have taken photographs of these hazards and presented them to city staff.
Eventually it became too tenuous for the trash truck drivers to traverse the
deep ruts. It was at this point in time, my residential "curbside" pick up was
discontinued. I was not notified, it was just cutoff. When I phoned to
complain about a lack of service, the rude and surly representative told me
of supervision's decision to discontinue it. The following week I was to
have the 6 barrels of waste positioned on D Street, +/- 200 feet distance in
each direction for 6 containers. Asked when I was to be notified. of this
change, I was told, "When you called in to complain". As absurd as this
sounds, regarding that current week's pick up, it would have been easier to
haul the trash to a landfill myself, than to have to argue with a rude
employee about the company's poor means of communication resulting in
my situation, my lack of service for that week. It was only with supervisory
intervention that the trucks were dispatched to haul my refuse away.

Putting my cans to the asphalt has not solved the situation. The path
becomes deeply eroded making the shuttling of the containers risky. After
rains, there is standing water, several inches deep for a few days. I have to
hop to mounds to higher ground while hauling a container. Even worse,
after it rains, an enormous pool of water collects on the asphalt at the
intersection. of 1 S' Ave and D Street. I call it "the swamp". If my cans are in
place on Tuesday evening and rain comes in the night, the swamp can cause
a 96-gallon, full, container to become buoyant and spill its contents. Even if
the receptacles are upright on Wednesday morning, the trucks will not wade
into the deep, standing water to pick up my trash; and, I get no service.
And so it goes on........
My mailbox is located at the intersection of D Street and 1 s` Avenue, so
when the circumference of the swamp's surface is too large, I do not get
mail delivery for weeks. You see, the swamp will not recede.
Twice, public works has been out to create an above the ground ditch to
prevent the formation of the swamp. While this has improved the situation,
it has not solved it. The ditch ends just south of my property, and the rain
redirects to an area immediately behind my driveway. I have more than
once blown tires and scrapped my oil pan on eroded grooves. 1 own a small
sedan.
In 2003, I purchased tons of decomposed granite, rented a Bobcat dirt mover
and hired someone to fill in the erosion for the length of 1"Avenue from the
intersection of D Street to my second driveway, a distance estimated to be
nearly +/-300 linear feet. It all washed away with the first significant runoff.
Thereafter, I would move the dirt with a wheelbarrow and shovel to fill in
the erosion. For many years, I have hired people to do this work since I am
incapable due to multiple, permanent cervical injuries sustained in the line of
duty.

I have asked for help from the city to work on preventing water from
damaging private property as well keeping it possible for me to access my
residence. I asked for the assistance of city personnel from public works to
fill in the erosion.
When I asked, the responses I received varied. Below are some of the
statements by various departmental employees to me.
"We don't have to do this."
"It's not our responsibility."
"We will do it this one-time only."
"This is the last time we will do this. After this, it's your problem.
"This erosion is on private property."
"What do you expect! This used to be a naturally occurring river bed.
Water is going to flow downhill and there is nothing we can do about it"
"You own the problem property on 1"Avenue?"
"The previous owner violated the law. She was issued two Cease and
Desists letters." You will have to sign a statement that you will not violate
the law." (I refused, but did verbally agree to follow the law).
"You're the piece of property with the ]lamas".
"Some of us at city hall still remember the lady who used to live there for
many years. It was hell to deal with her. She always complained."
I once asked if the city would be interest in purchasing my property. The
response was "Maybe."
To date, no permanent solution has been created for my trash service, the
water collection, and my mail delivery. This upcoming winter's runoff will
undoubtedly create a vehicular impediment to entering and exiting my
driveway.
The city's land at times is overgrown with weeds and tumbleweeds. I clean
and keep clear the city land immediately in front of my fence, but no one
from the city comes to maintain the rest of it, ever.

I will narrate my additional, problemafic contacts with city personnel.
Fire Department
Three years ago, after the 2007 countywide firestorms, I asked the fire
department to notify the two (2) property owners directly north of my
property to clear away six to seven (6 - 7) foot high weeds for the purpose
of creating defensible space. To date, the parcels have never been cleaned,
and dense brush now exists. These parcels are one-fourth and one-fifth of an
acre, respectively, of unimproved land. This summer, I went to the
courthouse on 3`d Avenue to ascertain from the Assessor's Office the legal
owner of the adjacent property with the intention of contacting them myself
as I am not willing to risk another October fire season. Squirrels run freely
in the area and I have twice seen a large snake enter my property from the
adjacent parcel. Not a rattlesnake, but the snakes were perhaps four (4) and
six (6) feel long and four to five (4 - 5) inches in circumference,
respectively. My one/plus (1+) acre is always clear of combustible debris.
On a second occasion, a field fire broke out on land just north and west of
mine. It may have been owned by the city or a resident on the next street to
the west. I, along with others, called the fire department. When the fire
truck encountered the city's locked gate, I opened it. I was admonished to
provide a key to the fire department, lest next time, the lock be broken off
with bolt cutters. It was lucky I was home this time. I explained the gate
and the key belonged to the city. Fire personnel were unaware.
On a third occasion, a hiker found a man down in the field, his dog by his
side. The downed man and dog were brought to my driveway and left. I
saw it was an elderly neighbor, and 1 telephoned for an ambulance. I was
told of its delayed arrival by not being able to find the property because of
the dirt path.
I have been a friend to the fire department when once I stopped two male
teens after observing them igniting cherry-bomb firecrackers while walking

on the city's property. I confiscated the remaining contraband and turned it
over to fire department personnel.
Police Department
Over the years, I have called upon police services to report homeless people
camped on city property north of mine and for groups of youths who staged
a paint-ball encampment and would routinely play. Seldom in the company
of any adult, I once witnessed a child get hit in the head when he walked into
the city's gate. He had been distracted playing with his gun. The adult
present declined my offer of first aid intervention in spite of the child
bleeding from the forehead. I notified city personnel.
I reported an abandoned car after having witnessed it driving recklessly,
spinning out of control in deep mud and standing water during winter. The
abandoned vehicle was determined by officers to have been stolen. It had
crashed into a deep eroded area and been buried up to its windshield.
Two years ago, a tenant of mine told me a homicide occurred during a
domestic dispute by a homeless couple camped amongst the trees on 1 S`
Avenue.
Two years ago, I agreed to allow the canine police officers access to my rear
house for purposes of canine field training. The structure, being used for
storage only, was ideal for officers to hide amongst my belongings and
require the dogs to hunt. I provided a key for unlimited access and asked
only that my tenant, in the front house, be given one day advanced
notification.
Sewer Department
I have been told that deep, rushing, above-the-ground running water on 1't
Avenue is not the city's problem. I describe it as rugged and rushing enough
to make the cover of Field and Stream magazine.

I was asked to assist city employees in locating a sewer manhole cover
which could not be found. While I knew the general location, I could not be
certain of its exact location. It was found under several inches of dirt,
completely covered. A can of green spray paint was used on a stationary
object to mark its location. The man hole cover is inches away from the end
of my driveway.
While mowing my lawn this last spring, I was bitten no less than 22 times by
mosquitoes in about 30 minutes. There was standing water in the swamp
and standing water in the eroded areas of the city's property in front of my
fence. Shortly thereafter I became sickened. Fearing West Nile virus, I
paid the $225 for the blood test to determine if I had been infected. I now
pay someone to perform all yard maintenance out of concern for my health.
Planning Department
In 2004, 1 submitted the required number of sets of blueprints together with
the monetary fee, for consideration of converting the unpermitted rear house
(1,225 square feet) into a permitted granny flat (800 square feet). The plans
initially were rejected and resubmitted after the architect made the required
changes. As the plans were presented to the other departments for
consideration, the fire department responded to the planning department that
I would have to install a fire hydrant along ls` Avenue for it to give approval
to the plans. The public works department responded that I would have to
build a sidewalk and curb of several hundred feet for its corresponding
approval. What was estimated by a general contractor to cost me $70,000
was untenable when I would be required to build, then gift, all this expensive
infrastructure to the city. I applied for and was granted a six (6) month
extension to the blueprint submission, only to have the time period expire
because I could not get any departmental concessions to the desired
infrastructure. The cost of a sidewalk, curb, water pipes and fire hydrant to
1 sc Avenue would have been many times more than the actual cost of my
project.

Approximately one year later, I discovered from a retired city employee that
the amount of infrastructure demanded by city departments is not supposed
to exceed a percentage of the total cost of the project. Thus, planning
personnel had incorrectly applied the city ordinance to my situation,
effectively sinking my project. I am told had it been applied correctly, the
infrastructure requested would have amounted to approximately thirty
percent (30%) of the cost of my project, or $21,000. I could have afforded
that. I independently researched city ordinances without success of finding
any verbiage as to a percentage. It is still my desire, someday, to work with
city personnel to do what is necessary to recognize the second house as a
residential dwelling, although it would require re-zoning
It is disheartening, to say the least, for my property to be characterized as,
"that problem property". My address only need be verbalized and long
standing employees, with longevity, recognize it instantly. Nothing was
disclosed to me at purchase, but during my first contact with city personnel,
and it was clear something was not right. When I take the aggregate sum of
my contacts with city personnel and evaluate the totality of it all, I sincerely
believe that the city works harder at presenting obstacles than permanently
fixing them. The city owns a sizeable strip of land which abuts up to my
property. Surely as neighbors, we should be able to get along and help one
another. I believe, for my part, I have been a good neighbor to the city. I
have protected city interests, attempted to mitigate injury when warranted,
cleaned up yard waste in an effort to keep city land safe, and obeyed the
ordinance with respect to not illegally renting out the second structure, that
being the unpermitted, house. What I have wanted from the city is reliable
trash service, help in maintaining defensible space on the adjacent lots,
improving a health hazard by eliminating the swamp and keeping rushing
water from preventing me access to my residence. None of this has
happened.
I have need at this time to consider long term planning with respect to my
residence. I no longer wish to own this property if I am to expect the same
lack of commitment from city personnel as I have received these last 9+

years. I have not complained, not called The Turko Files, although my
former tenant did.
Even now while my time is valuable, I am required to get involved in petty
negotiation to have my trash service fulfilled. This not worthy of my time
and attention, as my mother's health is rapidly failing. I will be returning
home soon, after living away from my property for 5 'h years. Upon my
return, it is my intention to relocate my 93-year old uncle, recently widowed,
from Virginia to my property in Chula Vista to live his remaining years with
me. My sister and nephew currently occupy my property. 1 need to decide
to either convert the rear home to a permitted house or add on sizably to my
existing front home to make room for my return and the arrival of my uncle
next year.
If I am to be dealt with as poorly in the future as I have in the past, by city
personnel and employees of Allied Waste Services, then I would like to be
told that, forthrightly, that nothing will be changed, so that 1 may sell the
property and relocate to an area of the county which can accommodate my
needs. If the city's long range planning is to ignore and forget that this
block of 1" Avenue exists, pass the problems on to the next council
members, cajole us residents with changes in long range planning, then tell
us so. I would entertain selling this property to the city if it benefits future
uses. But I need to begin to seriously plan, now. If you, the city council
members, can assist me in finding a permanent solution to the ongoing kick-
the-can, temporary, yet problematic, aspects of living on 15` Avenue, I would
be most grateful If I can not expect to live with quiet enjoyment at my
property because of a lack of city responsiveness, then tell me that.

longer in the traffic division. We have to rotate out every 5 years since we are a small agency. That way it

Hi Officer P Diaz:
I am writing to follow up on a conversation we had on 9/1/11 regarding the safety of our
community at Eastlake Vista, specifically the location of Lake Crest Dr. The speed in which
vehicles travel along this road is too fast for a residential area and on 2 separate occasions, with
speed as a factor, have led to serious incidents. Please refer to case/report number 11-11488
and 11-13589
On 7!29/11 at about 4:30am, a drunk driver ran a stop sign on Lake Crest Dr heading south, lost
control of the vehicle and crashed into the wall in my front yard at a high rate of speed as
witnessed by an oft-duty officer. The vehicle hit the wall at such a high rate of speed that the rear
of the vehicle lifted into the air as it struck the wall and rotated to the right before landing on the
sidewalk. The vehicle ended up sideways on the sidewalk due to the speed and force of the
impact. Had it not been for the wall in front of my house, I have no doubt that the car would have
launched into my house. My house at 2798 Shadow Crest Ct is located on a corner and as cars
are driving south on Lake Crest Dr, my house is in the immediate direction of travel should a
vehicle lose control. The incident on 7/29!11 luckily did not result in any injury involving an
innocent bystander but had the incident occurred during the day or afternoon, it could have easily
involved a mom walking her baby, ajogger, a bicyclist, or kids playing.
On 8/31/11 at about 11 pm, an individual was driving his vehicle south bound on Lake Crest Dr
when he claims that an oncoming SUV was driving into his lane. He reacted by moving over to
the right antl continued to do so because the SUV continued to drive into his lane. The vehicle in
question ultimately moved so far over to the right that he drove onto the curb, struck a fire
hydrant, and crashed into a pine tree. This resulted in the fire hydrant wasting thousands of gallon
of water. This incident occurred about 10 feet from where the previous incident happened. ,
My hope is that the City of Chula Vista takes this matter seriously and acts swiftly to help make
our Community safer The City of Chula Vista needs to help reduce the speeds of vehicles as
_ they`re driving through this residential area and after notifying the City of Chula Vista of the
dangers of unchecked speeds on Lake Crest Dr, I feel that it is the responsibilty of the City of

Chula Vista to react in a timely manner. Below are my requests:
1. With that being said, I am requesting the City of Chula Vista install at least a pair of Stop signs
on the comer of Lake Crest Dr and Shadow Crest Ct because as you're heading south on Lake
Crest Dr or heading north on Lake Crest Dr, this is where the street begins to curve and 'rf you're
distracted or lose control, the vehicle will drive straight into my house {as happened on 7291'11)
or my neightwrs house across the street if you're heading north on Lake Crest Dr.
2. Install at least 2 speed limits signs as the street currently doesn't have any I'm requesting one
to be installed at the comer of Lake Crest Dr as you pass the stop sign heading south and the
other on Lake Crest Dr and S Paradise Ridge West as you're heading north.
3. Also, rf the speed limit isn't already 25 mph, we request the City of Chula Vista designate Lake
Crest Dr as a 25mph street.
4 We also request that the City of Chula Vista paint a center dividing line down the sweet to
include reflector lights to help guide cars and help them stay in their lane. 1 believe this will help
because of the incident that took place on 8/31/11 involved a vehicle that crossed into the lane of
oncoming Vafhc. If the center dividing lane was there with the reflector lights, it might have made
a difference because as the car crossed the center dividing lane, he would have drove over the
reflector lights which would have made some noise and made the driver realize that he was
crossing the lane.
5. Lastty, we request that the City of Chula Vista install speed bumps at various locations along
Lake Crest Dr as this street leads to a public park.
I've attached some photos for you to review. If you would like all of the photos that I took of the
incident or the video footage, please let me know. I've also attached a list of signatures that I've
gathered from various home owners in the area that agree that something needs to be done to
slow the cars down. I spent a few days walking door to door to ask for support. Of course, many
people were not home or didn't answer the door or in some instances, there were gates that
prevented me from entering the property.
Thank you for your attention to this matter and I look forward to a speedy resolution. Please let

pair on [he corner of Lake Crest Dr and Lake Crest Ct. We are also requesting the City of Chula place at (east 2 speed limits sign
as you pass the stop sign heading south and the other on Lake Crest Dr and S Paradise Ridge West as you're heading north. AID
mph, we request the City of Chula Vista designate Lake Crest Dr as a 25mph street. We also request that the City of Chula Vista
street to include reflector lights to help guide cars and help them stay in their lane. Lastly, we request that the City of Chula ~
