SUMMARY
In accordance with the emergency provisions of Section 1009 of the City Charter, City staff
contracted the services of TC Consh~uetion Company, Inc. (General Engineering Contractor
License No. 402459) for the repair of storm drain facilities located at, and upstream of, "I'~ Street
and Claire Avenue. The repair was completed on April 03, 2012. An Informational Item was
submitted on December 30, 2011 (Attachment 1) indicating that staff would report back to City
Council after the full cost of the project was identified. This report presents the total
expenditures for the emergency repair work The proposed action would amend the FY 11/12
CIP budget; accept the final repart of expenditures for the emergency storm drain repairs at 'I"
Street and Claire Avenue (DR191); reduce the DRI80 CIP Budget by $100,000 and appropriate
the equivalent amount to DR191; make a finding that an emergency existed; and ratify the
contract with TC Construction Company, hic. for emergency repair work.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project falls under
the statutory exemption pursuant for Emergency Projects in accordance with Section 15269(b)
and (e) of the State CEQA Guidelines because the proposal consists of emergency repair actions
to public storm drain facilities to prevent or mitigate an imminent threat to life and property.
Thus, no further environmental review is required.

DISCUSSION
Severely deteriorated and corroded 24" & 30" diameter corrugated metal pipe ("CMP") storm
drain was discovered within the storm drain system between residential properties from 86 "P'
Street southerly to 634 Claire Avenue and then easterly to 675 Dennis Avenue. This storm drain
is within public rights-of--way (Claire, Robert, Arthur and Dennis Avenues) and public storm
drain easements between private properties, as shown in Attachment 2.
The approved 2011-12 Capital Improvement Program included a $250,000 project (DR191) to
line or replace portions of this storm drain system, starting from the downstream end and
continuing as far upstream as possible with the available funding. Based upon previous CCTV
inspections of the system's condition, staff programmed this rehabilitation work for summer
2012. However, on December 20, 2011, this system was re-televised after a series of intense rain
events and it was discovered that the bottoms of two segments of pipe near 634 Claire Avenue
had completely corroded out, with large voids around the pipes; similar damage was discovered
further upstream of Claire Avenue.
It became evident that the rate of deterioration of the system had accelerated significantly, staff
recommended that rehabilitation of the entire storm drain system be performed immediately, on
an emergency basis, due to imminent threat to public safety and public and private property. At
that time, Public Works -Engineering staff estimated cost of this emergency repair work to be
$350,000, including construction and City staff costs. This amount is $100,000 more than the
approved DR191 budget of $250,000. The additional $100,000 was utilitized from the DR180
project, which was established in the FY 2009-10 CIP budget for emergency replacement of
failed storm drains, primarily CMP failures, throughout the City.
The Director of Public Works and the City Manager agreed with the recommendation of staff on
the necessity to proceed with the emergency repairs for the entire system.
In accordance with City Charter Section 1009, and based upon the urgent necessity for the
preservation of life, health and property, City staff solicited three informal bids and contracted
the services of the low bidder, TC Construction Company, Inc., to repair the storm drain
facilities.
The approval of the resolution would: (7) amend the Fiscal Year 2011/2012 CIP Budget (2)
accept the final report of expenditures for the "Emergency Storm Drain Repairs at 'P Street and
Claire Avenue (DR191)", (3) reduce the DR180 CIP Budget by $100,000 and appropriate the
equivalent amount to DR191, (4) make a finding that an emergency existed, and (5) ratify the
Contract with TC Construction Company, Inc for said emergency repair work. A breakdown of
the total costs is provided under Current Year Fiscal Impact. The final amount paid to the

Contractor is higher than the base bid amount submitted by the contractor due to an approved
increase in line item quantities during the course of construction.
Contractor Selection Process
Staff prepared and solicited three informal bids from qualified contractors that had previously
worked for the City of Chula Vista. On January 19, 2012 the City received three proposals. The
Contractors were ranked as follows:

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the property, which are the subject action.
CURRENT YEAR FISCAL IMPACT
The Storm Drain Repairs at 'P Street and Claire Avenue Project (DR191) was established in the
approved Capital Improvement Program FY11/12, with a total of $250,000 allocated from
Transnet Funds, to line or replace portions of the storm drain system within and west of Claire
Avenue, and to continue as far upstream as possible with the available funding. It was
determined that the entire system should be lined upstream of Claire Avenue on an emergency
basis at a total project cost of $350,000. The additional $100,000 was utilitized from the DR180
project, which was established in the FY 2009-10 CIP budget for emergency replacement of
failed storm drains, primarily CMP failures, throughout the City. A summary of the project
costs is as follows:

two segments of pipe near 634 Claire Avenue were detetmined to have completely corroded out,
with Large voids around the pipe at these locations. Because the deterioration of this pipe has
accelerated significantly, staff now recommends that rehabilitation of this storm drain system be
performed immediately, on an emergency basis, due to imminent threat to public safety and
public and private property. Futher, because of contractor mobilization costs and the advanced
age of the storm drain system, staff proposes to rehabilitate the entire system at this time at a
total estimated cost of $350,000.
Due to heightened awazeness of significant corrugated metal pipe (CMP) failures throughout San
Diego County in 2004 and 2005, on March 22, 2005, the City contracted with Hirsch &
Company Consulting Engineers to evaluate the existing condition of the approximately 88,000
lineal feet of corrugated metal pipe (CMP) storm drain within the city limits. In November 2005,
Hirsch & Company delivered a prioritized CMP repair report listing atl_inspected CMPs, with
the associated recommended priority and recommended timing for the rehabilitation of each pipe
segment. Due to the conditions of the inspected pipes and the projected rates of deterioration of
these pipes, the consultant recommended that all pipes be replaced or structurally lined within
one to fve years of the report's submittal.

Much of the approximately 2,282 lineal feet of existing CMP identified as "Priority 1" has been
rehabilitated, largely due to funding provided to the City through the Federal Department of
Housing and Urban. Development. However, very little of the CMP under Priorities 2, 3 and 4,
totaling approximately 33,993 lineal feet, has been addressed, due to budget constraints and the
lack of dedicated funding for CMP rehabilitation and drainage projects. As a result, CMPs in
Priorities 2, 3, and 4 are currently rehabilitated on an emergency basis only as failures occur,
which is costly and inefficient compared with performing rehabilitation on a prescribed priority
schedule. Further, without a dedicated funding source to rehabilitate these pipes and with the
passage of time, the rates of CMP deterioration and failure will continue to increase into the
foreseeable firture.
With your concurrence, staff will solicit three informal bids from at least three qualified
contractors and perform this storm drain rehabilitation work on an emergency basis in
accordance with provisions in Section 1009 of the City Charter in order to assure the protection
of the public and of public and private property.
FISCAL IMPACT
There aze no direct or dedicated funding sources for the maintenance and repair of storm drain
facilities. 'T'his Project was added as DR-191 to the C1P FY 11!12, with a total of $250,000
allocated from Transnet Funds. It is anticipated that an additional $100,000 in Transnet Funds

from CIP Project No. DR-180, "Emergency Storm Drain Replacement at Various Locations,
will be needed to complete all necessazy work.
Staff will return with a Council Agenda item in May 2012 to report final emergency repair costs
and to appropriate funds, as necessary.

immediately, on an emergency basis, to preserve the health safety and welfare of the general
public as well as to public and private property; and
WHEREAS, in accordance with City Charter Section 1009 and based upon the urgent
necessity for the preservation of life, health and property; City staff solicited three informal bids
and contracted the services of the low bidder, TC Construction Company, Inc., to repair the
storm drain facilities; and
WHEREAS, Public Works-Engineering staff estimated cost of this emergency repair

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby amend the Fiscal Year 2011/2012 CIP Budget; accept the final report of
expenditures for the "Emergency Storm Drain Repairs at 'I' Street and Claire Avenue (DR191)";
reduce the DRI80 CIP Budget by $100,000 and appropriate the equivalent amount to DR191;
make a finding that an emergency existed; and ratify the Contract with TC Construction
