OF THE CITY OF CHULA VISTA
July 10, 2012

A Special Joint Meeting of the City Council and the Successor Agency to the Redevelopment
Agency of the City of Chula Vista was called to order at 10:00 a.m. in the Council Chambers,
located in City Hall, 276 Fourth Avenue, Chula Vista, California.

GRANTS FUND FOR THE URBAN AREAS SECURITY INITIATIVE TRAINING
PROGRAM
Staff recommendation: Council adopt the resolution.
ACTION: Mayor Cox moved to approve stafYs recommendations and offered Consent
Calendar items 1 through 12, headings read, text waived. Councilmember
Bensoussan seconded the motion, and it carried 4-0.

PUBLIC COMMENTS
Joseph Godwin, representing Friends of the Emerson and Alpine Pepper Trees, thanked the
Council and recognized the City its for use of shade trees.

Bill Schlegel, representing Terry's Park Homeowners Association, spoke regarding the difficulty
some residents may have in paying the mobilehome program fee.
Penny Vaughn, representing Chula Vista Mobile Home Residents Association, and Mazgazet
Daniels, Chula Vista resident, expressed concern for the way the mobilehome program has been
administered.
At the request of Mayor Cox, there was consensus of the Council to direct the City Manager to
provide an update on The status of the mobilehome rent review program with regard to the
feedback received by the public.
PUBLIC HEARINGS
13. PUBLIC HEARING TO CONSIDER TESTIMONY FOR THE FISCAL YEAR
2012/20]3 LEVY OF ASSESSMENTS AND COLLECTION AGAINST THOSE
ASSESSMENTS FOR CITY OPEN SPACE DISTRICTS 1 THROUGH 11, 14, 15, 17,
18, 20, 23, 24, 26, 31, 33, EASTLAKE MAINTENANCE DISTRICT NO. 1, TOWN
CENTRE AND BAY BOULEVARD MAINTENANCE DISTRICT (Director of Public
Works).
Notice of the hearing was given in accordance with legal requirements, and the hearing was held
on the date and at the time specified in the notice.
Deputy Mayor Castaneda stated he would abstain from voting on item 13B due to a potential
property-related conflict of interest. He left the dais during discussion and voting on the item.
Mayor Cox opened the public hearing. There being no members of the public who wished to
speak, Mayor Cox closed the public hearing.
ACTION: Councilmember Ramirez moved to adopt Resolutions Nos. 2012-142 and 2012-
144, headings read, text waived. Councilmember Bensoussan seconded the
motion, and it carried 4-0.

0-1, with Deputy Mayor Castaneda abstaining.

14. CONSIDERATION OF AMENDING TITLE 1 OF THE CHULA VISTA MUNICIPAL
CODE SPECIFYING PROCEDURES FOR REQUESTING REASONABLE
ACCOMMODATIONS
Notice of the hearing was given in accordance with legal requirements, and the hearing was held
on the date and at the time specified in the notice.
Principal Project Coordinator Hines presented the proposed ordinance regarding procedures for
requesting reasonable accommodations for persons with disabilities seeking equal access to
housing.
Mayor Cox opened the public hearing. There being no members of the public who wished to
speak, Mayor Cox closed the public hearing.
ACTION: Deputy Mayor Castaneda moved to place the following ordinance on first reading,
heading read, text waived. Councilmember Ramirez seconded the motion, and it
carried 4-0.
ORDINANCE OF THE CITY OF CHULA VISTA ADDING CHULA VISTA

15. PROPOSITION C: CITY ATTORNEY'S REPORT ON REQUIREMENTS FOR
IMPLEMENTATION AND NEXT STEPS
City Attorney Googins presented a report on requirements for implementation of Proposition C
and the next steps in the process.
At the request of Mayor Cox, there was consensus of a majority of the Council to request the
City Attorney solicit information from outside counsel and share the results at the Council
meeting of August 7, 2012, as well as alert the Charter Review Commission and Board of Ethics
that the item would be discussed at that time.
OTHER BUSINESS
16. CITY MANAGER'S REPORTS
City Manager Sandoval suggested Council consider holding Council meetings at 10:00 a.m. for
the remainder of the meetings in July and August 2012. City Attorney Googins suggested he

provide Council with legal input regarding changing a series of meeting times at its regular
meeting of June 17th.
Assistant City Manager Halbert stated the City received an invoice from the County of San
Diego, which is apass-through demand from the State of California for $5.5 million, relating to
the Successor Agency to the Redevelopment Agency.
17. MAYOR'S REPORTS
A. Consideration by the Council to sign a letter in response to the Grand Jury Report: City of
Chula Vista Tourism Marketing District.
At the request of Mayor Cox, there was consensus of the Council to authorize Mayor Cox to
draft and submit a letter in response to the Grand Jury Report: City of Chula Vista Tourism and
Marketing District on behalf of the Council.
B. Consideration of ratification of reappointments to City boards and commissions
ACTION: Mayor Cox moved to ratify the following reappointments. Deputy Mayor
Castaneda seconded the motion, and it carried 4-0.

18. COUNCILMEMBERS' COMMENTS
Deputy Mayor Castaneda suggested a referral to staff to provide a report regarding proposed
State bills regarding the elimination of redevelopment agencies.
Deputy Mayor Castaneda requested the City Attorney's office investigate a possible recession
relief fund. City Attorney Googins stated his office would provide a memorandum with further
information on the item.
In response to Deputy Mayor Castaneda's question, Assistant City Attorney Halbert provided
information on the opportunity for public to make comments on Coastal Commission issues at a
local meeting. He also stated that transportation to the Commission's meeting in Santa Cruz
might be available for those who wished to address the Commission directly.
Councilmember Bensoussan announced the following events: a community seminar on
immigration law and a wildlife restoration celebration.
Councilmember Ramirez encouraged City staff to continue recognizing work teams throughout
the City. He also requested staff investigate the improvement of teleconferencing options.
At the request of Councilmember Ramirez, there was consensus of the Council to add to the next
agenda Council consideration of the endorsement of the 2013 International Friendship Games.
Mayor Cox announced that the Council would convene in Closed Session to discuss the items
listed below.
At 1:00 p.m., the Council convened in Closed Session.

City Manager Sandoval explained the bill and recommended the Council approve the payment
under protest. He stated staff believes the payment calculation is flawed.
Agency Counsel Googins stated that, along with other agencies, the City has engaged outside
counsel to file a complaint against the County of San Diego and the State Department of Finance
to prevent the County from collecting and distributing payment to the taxing agencies.
At the request of Chairperson Cox, there was consensus of the Council to send letters to the
recipient agencies requesting they not spend any monies received until the situation has been
resolved.
Assistant Director of Development Services Crockett stated that the amount billed is under
dispute and that staff believes the correct amount would be approximately $2 million.

ACTION: Agency Member Castaneda moved to approve Resolution No. SA 2012-007,
heading read, text waived. Councilmember Bensoussan seconded the motion, and
it carried 5-0.
Chairperson Cox stated the Council would not convene in Closed Session to discuss the item
below.
