BACKGROUND:
Mr. & Mrs. Harold M. Benhardt have applied for a building
permit to construct a residential dwelling at the northwest
corner of "D" Street and Minot Avenue ( #100 Minot Avenue)
with a valuation over $5,000.
Ordinance 1205 requires the acquisition of additional
right of way in conjunction with issuance of such a building
permit. "D" Street was originally dedicated as a 40 -foot
right of way. This dedication of 5 -1/2 feet of additional
width offered by Mr. & Mrs. Harold M. Benhardt is in conformit
with the current standard of 51 foot right of way. No
dedication is required along Minot Avenue.

SUBJECT: Accepting Grant Deed, dedicating and naming property for
street purposes on "D" Street
Your office is requested to prepare the necessary [X] Resolution;
[ ] Ordinance; [ ] Agreement; to be presented to the City Council for
action on January 4 , 1972, on the subject matter.

On December 17, 1971, Mr. & Mrs. Harold M. Benhardt signed a grant
deed granting the City a strip of property located on the northerly
side of "D" Street, west of Minot Avenue for street purposes. The
subject dedication is adjacent to #100 Minot Avenue.
"D" Street was originally dedicated and accepted through the
recordation of the map of Rosebank Subdivision on January 18, 1911.
The street was initially dedicated with a 40 -foot right of way.
Current standards call for a 51 -foot width.
Article 5 of Ordinance 1205 requires the dedication of needed
right of way as a condition of issuance of a building permit.
Therefore, it is a requirement of the City that a 5 -1/2 foot
width be dedicated from each side of the street so as to ultimately
provide the total width of 51 feet. This dedication will provide
such additional width along the north side of the street only.
Please prepare a resolution for Council action accepting the
subject grant deed and dedicating and naming the described parcel
as "D" Street. The resolution should further instruct the City
Clerk to record the document in the office of the San Diego County
Recorder.
