RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AMENDING SECTION 3 OF RULE IX OF THE CIVIL SERVICE RULES
AND REGULATIONS RELATING TO SICKNESS AND DEATH LEAVE
The City Council of the City of Chula Vista does hereby
resolve as follows:
That Section 3 of Rule IX of the Civil Service Rules and
Regulations be, .and the same is hereby amended to read as
follows:
Rule IX. Section 3.
Sickness and Death Leave:
The objective of this section is to provide orderly
methods of furthering the health and safety of City
government employees and aiding employees to do better
work.
Sick leave, under this rule, is not a right which an
employee can use at his discretion, but a privilege which
can be allowed only in case of necessity and actual
sickness or injury or serious illness of immediate family
members which compel an employee to be absent from work.
In order to be able to be allowed sick leave with pay, an
employee should notify his supervisor not later than four
(4) hours after the time set for beginning his daily duties.
An employee holding a full-time or part-time position
with probationary or permanent status may be allowed
a leave of absence from duty without loss of salary
on account of sickness or injury. Sick leave with pay
is cumulative at the rate of one work day for each month
of service beginning at the time of full-time probationary
employment. A person who has held a position with tem-
porary or interim status and is appointed to a position with
probationary status, without a break in service, may have
such time credited to sick leave upon the recomme~ovaloofof

the Chief Administrative Officer. Unused sick leave may
be accumulated to a total of one hundred twenty (120)
work days.
Absence for illness may not be charged to sick leave not
already accumulated. Unused sick leave shall not be
considered in calculating severance pay.
A doctor's certificate or a personal affidavit showing
the nature of and cause of sickness or injury must be
furnished to the employee's immediate superior, for file
in the employee's personnel jacket, upon return from an
absence necessitating the use of more than four (4) working
days of sick leave. A doctor's certificate or personal
affidavit must also be presented by the employee before
returning to work to his immediate supervisor in all cases
when the employee has been exposed to a contagious disease
and for all office visits for medical or dental treatment.
Sick leave shall not be granted to an employee who is
absent from duty due to illness or injury incurred while
gainfully employed by other than the City of Chula Vista.
However, sick leave benefits may be used when such
employment has been formally recognized and approved by
Administration. Such recognition and permission to engage

in off-duty work will be handled through forms provided
by Administration.
Pregnancy in and of itself is not a sickness warranting
the granting of sick leave. Illness accompanying
pregnancy but not a normal condition thereof, may warrant
the granting of sick leave where such illness is estab-
lished by the certificate of a licensed physician. Fathers
may be granted sick leave to care for their ill child
but not in excess of two days.
Fathers may use sick leave to care for their family when
wife is in or returning from hospital for maternity
purposes. Amount of sick leave shall be determined by
department head and Personnel Officer recommendation and
Chief Administrative Officer approval.
An employee who becomes ill and notifies his supervisor
while on approved annual vacation may request that all
or part of such time, the employee was ill, be charged
to sick leave. A physician's certificate or personal
affidavit is required in all cases.
The smallest unit of time chargeable for sick leave
benefits is one hour.
The immediate family shall include: Mother, Father,
Husband, Wife, Son, Daughter, Sister, Brother or a
relative living in the employee's household.
An employee who is entitled to temporary disability
indemnity as approved by the City's Workman's Compensation
Insurance Carrier may use sick leave or other earned
leave benefits, as when added to his disability payment
will result in full payment not to exceed his monthly
salary or wage. An employee shall receive credit for
holidays occurring during a leave of absence hereunder.
An employee claiming sick leave benefits in case of
on-the-job injury shall have a doctor's certificate of
release to return to work.
When an employee with permanent stAtus is compelled to
be absent from work because of death of an immediate
family member and, after such employee makes a written
request and receives written department head approval,
such employee may be allowed the privilege to be absent
from work with full pay up to three days, plus reasonable
travel time. Travel time will be actual time used,
not to exceed five (5) calendar days. Paid absence for
family death shall be charged to accumulated sick leave.
