O. Box 505, Chula Vista, California, hereinafter called "Elks Lodge"; W I T N E S S E T H WHEREAS, the Benevolent and Protective Order of Elks, Chula Vista Lodge No. 2011, is presently proceeding with the annexation of the property located at 666 Telegraph Canyon Road, more particularly described as: The Northeast Quarter of the Northeast Quarter of Quarter Section 89 of Rancho de is Nacion according to recorded Map thereof No. 166, filed in the office of the County Recorder, County of Sail Diego, State of California; and WHEREAS, Elks Lodge desires to install and connect necessary sewer laterals to the main sewer line located in Telegraph Canyon Road to carry sewage from said premises into the Metropolitan Sewer System, and WHEREAS, Elks Lodge desires to make said connection prior to the completion of the annexation of said premises to the City of Chula Vista, and ' WHEREAS, the City of Chula Vista is agreeable to permitting said connection to the sewer system prior to the completion of said annexation subject to the terms and conditions set forth in this agreement. NOW, THEREFORE, in consideration of the premises and for other good and valuable consideration, receipt of which is hereby acknowledged, it is mutually agreed by and between the parties hereto as follows: 1. Elks Lodge agrees to deposit the sum of TWO THOUSAND, FIVE HUNDRED EIGHTY-EIGHT AND 72/100 DOLLARS ($2,588.72) to cover the necessary cost for the connection of the sewer lateral located at 666 Telegraph Canyon Road to the main sewer line in Telegraph Canyon Road. Siad sum, which shall be deposited concurrent with the execution and approval of this agreement, covers the following assessments and fees: Assessment of $225.84 per acre for Telegraph Canyon Sewer Line .............$2,278.72 6" Lateral Fee ............................ 275.00 Inspection Fee ............................ 25.00 Connection Fee ........................... 10.00 TOTAL •$2,588.72 2. Elks Lodge further agrees that none of said sum shall be refundable except for the assessment for Telegraph Canyon Sewer Line in the event that said connection is removed at a later time pursuant to the terms of this agreement. 3. All work performed by Elks Lodge on the portion of the sewer lateral located on private property shall be performed in accordance with standards of the City and subject to inspection -1- ~ ~~ by the Building Department of the City of Chula Vista. 3. 2t is further mutually understood and agreed c~_y and between the parties hereto that if said premises are not annexed to the City of Chula Vista for any reason whatsoever on or before the lst day of January, 1967, said sewer connection will be removed ar_d sewage front said premises will no longer be permitted to flow inta the sewer line in Telegraph Canyon Raad. a. It is further agreed that City shall, at its option, at any time subsequent to said date of January 1, 1967, institute necessary work required. to perforrl the disconnection of said sewer hook-up withaut further notice to Elks Ladge. 5. Flks Lodge agrees to pay in full thc- cost of said. disconnection if it is required pursuant to the terms of this agree- ment. Said cost of disconnection shall be determined by the City Engineer of the City of Chula Vista, and shall be withheld from the sewer assessment charge on deposit in the amount of $2,278.72, and the balance thereof shall not be refunded until the completion of the ~~~ork of disconnection and the total cost of sar:e i-~as been ascertained.
