RESOLUTION N0. 4221
RESOLUTION OF T_IE CITY COUNCIL OF THE CITY OF CHULA VISTA
OPPOSING PROPOSITION NO. 16, AND URGING TI-iF?~ PASSAGE OF
SOUND LEGISLATION TO CONTP.OL THE LICENTIOUS DISTRI3UTION
OF PORNOGRAPI~IC LITERATURE
The City Council of the City of Chula Vis-~a does hereby
resolve as follows:
WHEREAS, the City Council of the City of Chula Vista has
long recognized the ;rave problems of the State of California in
relation to the distribution of obscene and pornographic literature
and has supported the adoption of strong legislation to properly
control the distribution of such materials, and
NIHEREAS, the City Council of the City of Chula Vista, on
April 27, 1965, adopted Resolution No. 3701 supporting Assembly Hill
No. 87 which would have denied access to children of materials which
would tend to corrupt minors, and
WHEREAS, said resolution read, in part, as follows:
"WHEREAS, the City Council of the City of Chula Vista has
heretofore on several occasions expressed its support of the growing
community concern over the real and devastating effects of the free
availability of obscene and pornographic literature, and has urged
a concerted effort to curb thc- dissemination of suciz literature, and
"WHEREAS, the Supreme Court of the United States has recog-
nized the legitimate and vital interests of the states and localities
to prevent such dissemination of material being harmful to children
and has urged said governmental agencies to direct their laws to the
prevention of the distribution of objectional material to children
rather than attempting to quarantine the general reading public
against such materials, and..."

bdHEREAS, Proposition No. 16, which will be on the ballot of
November 8, 1966, fails to achieve the goals desired by the City
Council of the City of Chula Vista and all of those concerned with
the problem of obscene and pornographic literature, and

WHEREAS, Proposition No. 15, if adopted, would remove from
the California legislature and the municipalities the power to amend
or modify our laws on obscenity and the power to develop meaningful
laws to protect children from harmful material in the manner proposed
by Assembly Sill No. 87, introduced by Assemblyman Richard Donovan,
and
WHEREAS, serious questions have been raised as to the basic
constitutionality of Proposition No. 16, in that it does not conform
to the standards established by the Supreme Court of the United States
and deprives the judiciary and prosecuting attorneys of needed dis-
cretion in controling this problem of pornographic literature, and
WHEREAS, Proposition No. 16 is opposed by the District
Attorneys' Association, the State Bar of the State of California, the
California Libraries Association, the District Council of Churches,
the Chula Vista Library Board of Trustees, and many other informed
institutions, including newspapers such as the Los Angeles Times, the
San Diego Union and Tribune, the Chula Vista Star News and other news
media.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that in the interests of affording real protection
to the minors of this community and promoting the total objective of
properly curbing the distribution of obscene and erotic materials,
that said Council does hereby oppose the enactment of Proposition No. 16
and urges every voter to vote "NO" on Proposition No. 16.
BE IT FURTHER RESOLVED that the City Council of the City of
Chula Vista does hereby strongly urge the adoption of a constitutional
and workable legislative act by the State Legislature, such as Assembly
Bill No. 87, to prohibit the distribution of said harmful materials to
children.
