HomeMy WebLinkAboutReso 1966-4214RESOLUTION NO. 4214 RESOLUTION OF THE CITY COUNCIL OF TrIE CITY OF CHULA VISTA APPROVING AGREEMENTS BETS°~EEN THE CITY OF CHULA VISTA AND CERTAIN PROPERTY OL~INERS ABUTTING "G" STREET, HILLTOP DRIVE, OR PEPPER TREE LANE IN TI-IE CITY OF CHULA VISTA FOR PARTICIPATION IN THE INSTALLATION OF A SE6'7ER LINE EXTENSION IN "G" STREET AND HILLTOP DRIVE, AND AUTHORIZING TIE MAYOR TO EXECUTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: That those certain agreements between the City of Chula Vista, a municipal corporation, and certain property owners abutting "G" Street, Hilltop Drive, or Pepper Tree Lane in the City of Chula Vista for parti- cipation in the installation of a sewer line extension in "G" Street and Hilltop Drive, dated the 19th and 29th days of October, 1966, copies of which are attached hereto and incorporated herein, the same as though fully set forth herein be, and the same are hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreements for and on behalf of the City of Chula Vista. BE IT FURTHER RESOLVED that if the bids received for the above sewer line extension are over 25% above the Engineer's estimate for said work, no award of contract will be made without the approval of the participating property owners first being had and obtained. City shall construct a sewer line extension along '°G" Street, Hilltop Drive and Pepper ?•ree Road in accordance with plans ar_d specifications estimated to cost $10,760.00 as approved by the City Engineer of the City of Chula Vista. ~•~\~ ~ 2. Owner agrees to make a cash deposit of ~`Er9~.30 with the City prior to the construction of the sewer, which amount is proportionate to the benefit conferred upon Owner's property, as determined from the approved plans and specifications and cast estimate. '~'t;.e cost estimate shown includes the construction of an 8" VCF sewer main only and does net contemplate the installation of sewer laterals. 3. O~arner agrees that if the actual cost of the construction of said sewer line extension exceeds the amount of the deposie Y~asen upon the estimated cost, Owner will pay to the City prior to connection to said sewer line the difference between the amount cf deposit and the actual cost of the construction of the sewer line. City agrees that should the actual cost of the sewer line extension be less thar, the estimated cost, any balance remaining of the deposit made by Own~ar will be returned. 4. City agrees to contribute at its own cost all engineerz?~g and inspection Services. 5. AGREEMENT THIS AGREEMENT, made and entered into this 29th day of September 1966, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City", and Laurl w. & Bernice C. Moffitt hereinafter called "Owner", W I T N E S S E T H WHEREAS, the installation of a sewer line extension in "G" Street, Hilltop Drive and Pepper Tree Road is desired to provide necessary sewer service to the property owners in the area concerned, and WHEREAS, City desires to install this sewer with the financial assistance of the benefiting property owners, and WHEREAS, Owner, being one of the property owners abutting "G" Street, Hilltop Drive or Pepper Tree Lane whose property would be benefited by the installation of the sewer, agrees to participate in the cost of constructing said sewer. NOW, THEREFORE, IT IS AGREED, by and between City and Owner as follows: 1. City shall construct a sewer line extension along "G" Street, Hilltop Drive and Pepper Tree Road in accordance with the plans and specifications estimated to cost $10,780.00 as approved by the City Engineer of the City of Chula Vista. 2. Owner agrees to make a cash deposit of $ 845.91 with the City prior to the construction of the sewer, which amount is proportionate to the benefit conferred upon Owner's property, as determined from the approved plans and specifications and cost estimate. The cost estimate shown includes the construction of an 8" VCP sewer main only and does not contemplate the installation of sewer laterals. 3. Owner agrees that if the actual cost of the construction of said sewer line extension exceeds the amount of the deposit based upon the estimated cost, Owner will pay to the City prior to connection to said sewer line the difference between the amount of deposit and the actual cost of the construction of the sewer line. City agrees that should the actual cost of the sewer line extension be less than the estimated cost, any balance remaining of the deposit made by Owner will be returned. In the event that the total amount bid exceeds the Engineer's Estimate by 25°J or more, then the City agrees that no award of contract shall be made unless unanimous written approval is obtained from all property owners participating in the project. 4. City agrees to contribute at its own cost all engineering and inspection services. 5. It is hereby agreed that Owner will deposit the required amount of his participation, based upon the estimated cost, upon the request of City prior to the start of said construction. ~ u~.t~ 6. City agrees that the construction of the sewer line extension will commence if and when owners of 706 or more of the benefited frontage have executed the form of agreement set forth herein and have deposited their money as required herein. In the event that owners of 70go or more of the benefited frontage do not execute this agreement and make the necessary deposit, it is further agreed that City will return any and all deposits made, and con- struction will not be undertaken as provided herein. 7. City agrees to obtain a firm quotation for the in- stallation of sewer laterals in conjunction with the proposed sewer main. Owner desiring to have a sewer lateral installed concurrently with the main shall make payment of the stipulated amount directly to the contractor. Payment of the cost of the sewer lateral to the contractor shall be considered an individual matter beyond the scope or intent of this agreement. City shall inspect sewer laterals so installed for compliance with City standards. IN WITNESS WHEREOF, this agreement is executed by the City of Chula Vista acting by and through its Mayor pursuant to Resolution No. 4214 adopted by the City Council of the City of Chula Vista on the 25th day of October 1966, authorizing such agreement, and by Laurl W. and Bernice C.
