HomeMy WebLinkAboutReso 1966-4186RESOLUTION N0. 4186 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING SECOND JOINT POWERS AGREEMENT FOR A COMPREHENSIVE PLANNING ORGANIZATION FOR THE SAN DIEGO COUNTY REGIONAL GENERAL PLAN AND TRANSPORTATION POLICY COORDINATING COMMITTEE AND AUTHORIZING THE MAYOR TO EXECUTE SAME The City Council of the City of Chula Vista does hereby resolve as follows: That that certain Joint Powers Agreement for a comprehensive planning organization for the San Diego County Regional General Plan and Transportation Policy Coordinating Committee executed by the municipalities of the County of San Diego, the County of San Diego, the San Diego Unified Port District, and the State of California, a copy of which is attached hereto and incorporated herein, the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute said agreement for and on behalf of said City. DATEDo City Clerk CC-652 ~-y~`~~ REVISED DRAFT 8 8 66 JOINT P04dERS AGREEMENT COMPREHENSIVE PLANNING ORGANI7ATION WHEREAS, Section 9 of the Federal-Aid Highway Act of 1962 approved October 23, 1962, states in part: "It is declared to be in the national interest to encourage and promote the development of transportation systems embracing various modes of transport in a manner that will serve the States and local communities efficiently and effectively." To accomplish this objective the Secretary shall cooperate with the States, as authorized in this title, in the development of long-range highway plans and programs which are properly coordinated with plans for improvements in other affected forms of transportation and which are formulated with due consideration to their probable effect on the future development of urban areas of more than fifty thousand population. After July 1, 1965, the Secretary shall not approve under Section 105 of this title any program for projects in any urban area of more than fifty thousand population unless he finds that such projects are based on a continuing comprehensive transportation planning process carried on coo eratively by States and local communities in conformance with the objectives stated in this section; and WHEREAS, it is understood that failure to obtain approval. for projects in the San Diego planning region could result in a direct loss to this community of funds exceeding forty million dollars each year for highway improvement projects alone; and 61I-IEREAS, San Diego County is a Standard Metropolitan Area established I by the Bureau of the Census, a statistical area designated by the California ~- y ~ g6 Joint Pocaers Agreement 2 State IiZterdepartmental Research Coordinating Council, and an Economic Area designated by the California State Department of Finance; and therefore San Diego County agencies can provide their own comprehensive regional planning program by joint powers agreements, pursuant to Chapter 5, Title 1, Divis ion 7 of the California Government Code; and WHEREAS, the municipalities within San Diego County, the County of San Diego, the San Diego Unified Port District and the State of California recognized the need for such a planning program and therefore entered into a formal joint powers agreement dated October 28, 1963 ,.establishing such a continuous transportation planning process; and WHEREAS, since 1962 many additional Federal and State Acts have been passed, each requiring from local communities that there be in existence General Plans and an ongoing process of continuing comprehensive cooperative planning in order to be eligible for funding subject to these acts. A partial list follows: (1) Federal Highway Act, 1962; (2) Area Redevelopment Act, 1962; (3) Federal Airport Act, 1964; (4) Housing Act, 1964; (5) Public Sales Act, 1964; (6) Urban Mass Transportation Act, 1964; (7) Department of Interior Appropriation Act, 1965; (8) Housing and Urban Development Act, 1965; (9) Land and Water Conservation Fund Act, 1965; (10) Public Works and Economic Development Act, 1965; (11) Urban Mass Transit Act, 1965; (12) Housing and Urban Development Act, 1966; (13) Intergovernmental Personnel Act, 1966; (14) Rural Community District Redevelopment Act, 1966; (15) Urban Mass Transportation Act, 1966; (10) California Beach, Park, Recreational and Historical Facilities Bond Act, 1964; (17) California Land Conservation Act, 1965; and WHEREAS, botP State and Federal agencies in approving applications for ~-4is~. Joint Powers ~greemer_t 3 projects subject to these acts and other acts require that these applications be reviewed by the San Diego regional organization ~,ahich has been established to coordinate all planning activities within the area; and [~THEREAS, the Agency which has been established to coordinate all planning activities is required to be actively engaged in an ongoing process of continuing comprehensive, cooperative planning, and must find the applications of the local agencies to be in keeping with or not in conflict with the appropriate element of the general plan, which plan shall be adopted by the Board of Supervisors after completion; NGW THEREFORE, The undersigned governmental agencies ( (1) City of Carlsbad, (2) City of Chula Vista, (3) City of Del Mar, (4) City of Coronado, (5) City of El Cajon, (6) City of Escondido, (7) City of Imperial Beach, (8) City of La Mesa, (9) City of National City, (10) City of Oceanside, (11) City of San Diego, (12) City of San Marcos, (13) City of Vista, (14) County of San Diego, (15) San Diego Unified Port District, (16) State of California) do hereby agree as follows: 1. There shall be and hereby is established a comprehensive planning organization for the purpose of supplementing the transportation planning process by coordinating a county-wide plar~ring program ar~d by assuring a continuing comprehensive planning process in the County of San Diego. 2. The Comprehensive Planning Organization shall initially be structured as indicated on Attachment 1, with the provision that from time to time this organization may be modified by action of the Policy Coordinating Committee shown thereon. 3. The undersigned parties to this agreement pledge full cooperation u~~6 Joint Powers Agr. eemer_t 4 and agree to assign representatives to serve ~s official members of said organization, or of any subcommittees thereof, who shall act for and on be- half of said agencies in any and all matters which may come before said organization, subject to any necessary and lega 1 approval of their acts by the legislative bodies of the agencies which appoint them. 4. In addition to the agencies noted above as signatory hereto, any other San Diego County incorporated city which may desire to participate in the activities of this comprehensive planning organization may do so by executing this agreement without prior approval or ratification of the present signatories of this agreement and shall be bound to said agreement as of the date of execution.
