RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING PURCHASE AGREEMENT FOR ACQUISITION OF A PORTION
OF PALM GARDEN ESTATES SUBDIVISION FOR STREET RIGHT OF WAY
PURPOSES, AUTHORIZING THE MAYOR TO EXECUTE SAME, AUTHORIZING
THE CREATION OF AN ESCROW, APPROPRIATING AND AUTHORIZING
NECESSARY FUNDS, AND ACCEPTING GRANT DEED FROM CORTE MARIE
INVESTMENT COMPANY
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain agreement between the City of Chula Vista,
a municipal corporation, and James C. & Jerrine D. Patten, husband
and wife, and Corte Maria Investment Company, a corporation, dated
the ',5~' day of August, 1966, a copy of which is attached hereto
and incorporated herein, the same as though fully set forth herein
be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor be, and he is hereby
authorized and directed to execute said agreement for and on behalf
of said City.
BE IT FURTHER RESOLVED that that certain grant of real
property, made by grant deed executed by Corte Maria Investment
Company, dated the 12th day of August, 1966, to the City of Chula
Vista, a copy of which is attached hereto and by this reference
made a part hereof, the same as though fully set forth herein be,
and the same is hereby accepted as a grant in fee.
BE IT FURTHER RESOLVED that the City Attorney be, and he
is hereby authorized and directed to execute all necessary documents
for the creation of an escrow at the Bank of America National Trust
& Savings Association.
BE IT FURTHER RESOLVED that the sum of $49,539.00 be
appropriated from the unappropriated surplus of the General Fund,
and the sum of $31,961.00 be, and it is hereby authorized to be
expended from the 186.1 Gas Tax Funds for the purposes set forth
hereinabove.
