HomeMy WebLinkAboutcc min 2012/05/01MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA May 1, 2012 4:00 p.m. A Regular Meeting of the City Council of the City of Chula Vista was called to order at 4:04 p.m. in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, Califomia. ROLL CALL PRESENT: Councilmembers Aguilar, Bensoussan (arrived at 4:11 p.m.), Castaneda, Ramirez and Mayor Cox ABSENT: None ALSO PRESENT: City Manager Sandoval, City Attorney Googins, City Clerk Norris, and Senior Deputy City Clerk Bennett PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Chula Vista Superior Court Judge Stephanie Sontag led the Pledge of Allegiance. SPECIAL ORDERS OF THE DAY • OATH OF OFFICE Donald A. Johnson, Mobilehome Rent Review Commission. City Clerk Norris administered the oath of office to Commissioner Johnson, and Deputy Mayor Castaneda presented him with a certificate of appointment. • PRESENTATION OF A PROCLAMATION TO CHULA VISTA AQUATIC SUPERVISOR III MANUEL GONZALEZ, AND FIREFIGHTER MICHAEL FILSON, PROCLAIMING MAY 2012 AS DROWNING PREVENTION MONTH Mayor Cox read the proclamation and Councilmember Ramirez presented it to Aquatic Supervisor Gonzalez and Firefighter Filson. • PRESENTATION BY CHULA VISTA RECREATION DIRECTOR BUCK MARTIN REGARDING THE 2011 AWARD OF EXCELLENCE FOR PARK PLANNING FOR MT. MIGUEL PARK Recreation Director Martin commented on the recent recognition by the California Parks and Recreation Society, of the City's receipt of the 2011 Award of Excellence for Park Planning. WHITE, USN, RET., COMMENDING THE CHULA VISTA VETERANS HOME SUPPORT FOUNDATION FOR THEIR DEDICATION TO THE CHULA VISTA VETERANS HOME Mayor Cox read the proclamation and Councilmember Aguilar presented it to Captain Robert White. • PRESENTATION OF A PROCLAMATION TO CHULA VISTA ELKS LODGE EXALTED RULER LAURIE AYALA AND FORMER EXALTED RULER MARTIN BARROS PROCLAIMING MAY 1-7, 2012 AS YOUTH WEEK Mayor Cox read the proclamation and Councilmember Ramirez presented it to Mr. Barros and Ms. Ayala. • PRESENTATION OF A PROCLAMATION RECOGNIZING REBECCA LLEWELLYN, OWNER OF PAYCO SPECIALTIES, INC. AS THE SMALL BUSINESS ADMINISTRATION 2012 REGION 9 WOMEN IN BUSINESS CHAMPION Mayor Cox read the proclamation and Deputy Mayor Castaneda presented it to Ms. Llewellyn. Page 2 -Council Minutes May 1, 2012 CONSENT CALENDAR Councilmember Ramirez stated he would abstain from voting on item 6 due to a potential property-related conflict of interest. Item 6 was removed from the consent calendaz for separate consideration. 1. RESOLUTION NO. 2012-071 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AN AMENDMENT TO THE 2011/2012 ANNUAL ACTION PLAN FOR THE PURPOSE OF REPROGRAMMING UNENCUMBERED COMMUNITY DEVELOPMENT BLOCK GRANTS FUNDS TO THE CHULA VISTA VETERANS HOME SUPPORT FOUNDATION AND AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AN AGREEMENT WITH THE CHULA VISTA VETERANS HOME SUPPORT FOUNDATION FOR THE MANAGEMENT AND IMPLEMENTATION OF THE PROGRAM (Assistant City Manager/Development Services Director) Staff recommendation: Council adopt the resolution. 2. RESOLUTION NO. 2012-072 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA (1) APPROVING AMENDMENTS TO THE 2010-2015 CONSOLIDATED PLAN AND 2011-2012 HUD ANNUAL ACTION PLAN TO IMPLEMENT THE SECOND ALLOCATION OF EMERGENCY SOLUTIONS GRANT PROGRAM; (2) AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL RELATED DOCUMENTS NECESSARY TO OBTAIN THE HUD GRANT (Assistant City Manager/Development Services Director) Staff recommendation: Council adopt the resolution. 3. RESOLUTION NO. 2012-073 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA (1) APPROVING FISCAL YEAR 2012/2013 ANNUAL ACTION PLAN FOR COMMUNITY DEVELOPMENT BLOCK GRANT, HOME INVESTMENT PARTNERSHIP (HOME), AND THE EMERGENCY SOLUTIONS GRANT PROGRAMS; (2) AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AGREEMENTS FOR THE MANAGEMENT AND IMPLEMENTATION OF ELIGIBLE PROJECTS WITH EACH SUB-RECIPIENT/CONTRACTOR; AND (3) AUTHORIZING THE CITY OF CHULA VISTA HOUSING MANAGER TO ENTER INTO MOU'S WITH THE DIRECTOR OF PUBLIC WORKS REGARDING IMPLEMENTATION OF THE THIRD AVENUE STREETSCAPE PROJECTS AND THE DIRECTOR OF RECREATION REGARDING THE IMPLEMENTATION OF THE NORMAN PARK SENIOR CENTER PROJECT AND (4) AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL RELATED DOCUMENTS NECESSARY TO OBTAIN THE HUD GRANTS (Assistant City Manager/Development Services Director) Staff recommendation: Council adopt the resolution. RESOLUTION NO. 2012-074 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA (1) ESTABLISHING A NEW CAPITAL IMPROVEMENT PROJECT ENTITLED "MUNICIPAL SOLAR PHOTOVOLTAIC -PHASE II" (GG206), (2) AMENDING THE FY2011-]2 CAPITAL IMPROVEMENT PROGRAM ACCORDINGLY, (3) APPROPRIATING $9,889 IN UNANTICIPATED REVENUE TO GG206, AND (4) APPROVING A DESIGN BUILD AGREEMENT WITH SULLIVAN SOLAR POWER OF CALIFORNIA INC. FOR THE MUNICIPAL SOLAR PHOTOVOLTAIC - PHASE II PROJECT (GG206) (4/STHS VOTE REQUIRED) (Public Works Director) Staff recommendation: Council adopt the resolution. 5. RESOLUTION NO. 2012-075 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROPRIATING $10,000 FROM THE ASSESSMENT DISTRICT 90-2 OTAY VALLEY ROAD MAIN STREET (AD 90-2) IMPROVEMENT FUND FOR CONSULTANT SERVICES REQUIRED TO DETERMINE COMPLETION OF ENVIRONMENTAL WORK (4/STHS VOTE REQUIRED) (Assistant City Manager/Director of Development Services and Public Works Director) Staff recommendation: Council adopt the resolution. 6. Item removed from consent calendar. ACTION: Mayor Cox moved to approve staffs recommendations and offered consent calendar items 1 through 5, headings read, text waived. Deputy Mayor Castaneda seconded the motion, and it carried 5-0. ITEMS REMOVED FROM THE CONSENT CALENDAR Councilmember Ramirez previously stated he would abstain from voting on item 6 due to a potential property-related conflict of interest. He left the dais during discussion and voting on this item. 6. RESOLUTION NO. 2012-076 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ENTERING INTO A CONSENT TO USE OF LAND AGREEMENT WITH SAN DIEGO GAS AND ELECTRIC COMPANY FOR THE ORANGE AVENUE LIBRARY PARK SITE (Public Works Director) ACTION: Mayor Cox moved to adopt Resolution 2012-076, heading read, text waived. Deputy Mayor Castaneda seconded the motion, and it carved 4-0-1, with Councilmember Ramirez abstaining. PUBLIC COMMENTS Daniel Green, Chula Vista resident, suggested the Council consider banning hand sanitizes in the City at a future Council meeting. CONSIDERATION OF AMENDING THE CHULA VISTA MUNICIPAL CODE CHAPTER 5.52 AND ADDING CHAPTER 5.53 IN ACCORDANCE WITH THE CALIFORNIA DIGITAL INFRASTRUCTURE AND VIDEO COMPETITION ACT OF 2006 Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and at the time specified in the notice. Mayor Cox opened the public hearing and continued it to the Council meeting of May 22, 2012. OTHER BUSINESS 8. CITY MANAGER'S REPORTS There was none. 9. MAYOR'S REPORTS ACTION: Mayor Cox moved to appoint Jovita Juarez to the Commission on Aging. Deputy Mayor Castaneda seconded the motion, and it carried 5-0. 10. COUNCILMEMBERS' COMMENTS Deputy Mayor Castaneda congratulated Library Director Waznis and the staff for the success of the Library's recent fundraiser. He also reported he attended the League of Cities Legislative Action Days event. At Deputy Mayor Castaneda's request, there was Council consensus to investigate problems with speeding in the 600 block of Marcilla Way in the Rancho Del Rey area. Councilmember Bensoussan announced the City received the 2012 Playful City USA award from Kaboom! and the Humana Foundation. She also stated she visited the Washed Ashore exhibit at the Living Coast Discovery Center. She announced the following events: Cinco de Mayo, Art Swap on Marina, and the Onstage Playhouse production of Grease. Councilmember Aguilar commented on a memo from the City Manager regarding the Advanced Life Support program status. City Attorney Googins announced the Council workshop on Thursday, May 3, 2012, on the Brown Act Meeting laws. Councilmember Ramirez stated he would be hosting public office hours on Saturday, May 5, 2012, at the Animal Care Facility.
