RESOLUTION N0. 4341
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AMENDMENT TO USE PERMIT AGREEMENT BETWEEN THE
CITY OF CHULA VISTA AND CAVALIER MOTOR HOTEL AND AUNT EMMA'S
PANCAKE HOUSE, AND AUTHORIZING THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain amendment to the Use Permit Agreement
by and between the City of Chula Vista and Cavalier Motor Hotel and
Aunt Emma's Pancake House, approved by Resolution No. 3819 on the
10th day of August, 1965 and extended by Resolution No. 4163 adopted
on the 9th day of August, 1966, a copy of which amendment is attached
hereto and incorporated herein, the same as though fully set forth
herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
amendment for and on behalf of said City.

HOTEL and AUNT EMMA'S PANCAKE RESTAURANT,
called "Permittees,"
into this 7th day of

corporations, hereinafter
W I T N E S S E T H
WHEREAS, City and Permittees have heretofore entered into a
use permit agreement, approved by Resolution No. 3819 on the 10th day
of August, 1965 and extended by Resolution No. 4163 adopted on the
9th day of August, 1966, for the use of certain City-owned property
for the construction and maintenance of a billboard advertising
Permittees' business operations, and
WHEREAS, the property description contained therein has been
found to be in error, and
WHEREAS, it is desired to amend said use permit agreement to
correct the legal description of the subject property and for no other
purpose.
NOW, THEREFORE, IT IS AGREED by and between the City of Chula
Vista and Cavalier Motor Hotel and Aunt Emma's Pancake Restaurant
that the use permit agreement approved by Resolution No. 3819 on the
10th day of August, 1965, and extended by Resolution No. 4163 adopted
on the 9th day of August, 1966, be, and the same is hereby amended as
follows:
WHEREAS, Cavalier Motor Hotel and Aunt Emma's Pancake Restau-
rant, Permittees, desire to use that certain property owned by the
City of Chula Vista, located Westerly of Freeway No. 5, exclusively
for the construction, operation and maintenance of an advertising
bill-board or signboard, which property is more particularly described
as follows:
The Northerly 40 feet of the Southerly 95 feet of the
Easterly 70 feet of the Northerly 330 feet of the Westerly
449.47 feet of Quarter Section 161, Rancho de la Nacion,
according to Map No. 166 filed May 11, 1869 in the County
of San Diego, State of California.
IN WITNESS WHEREOF, the parties hereto have set their hands
the day and the year first hereinabove set forth.
