HomeMy WebLinkAbout2012/07/17 Item 01MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA March 27, 2012 4:00 p.m. A Regular Meeting of the City Council of the City of Chula Vista was called to order at 4:02 p.m. in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL PRESENT: Councihnembers Bensoussan, Castaneda, Ramirez (left at 4:13 p.m.) and Mayor Cox ABSENT: Councilmember Aguilar (excused) ALSO PRESENT: City Manager Sandoval, City Attorney Googins, City Clerk Norris, and Senior Deputy City Clerk Bennett PLEDGE OF ALLEGIANCE TO THE FLAG AND MOMENT OF SILENCE Deputy Mayor Castaneda led the Pledge of Allegiance. CONSENT CALENDAR Deputy Mayor Castaneda stated he would abstain from voting on item 4 due to a potential property-related conflict of interest. Item 4 was removed from the Consent Calendar for separate consideration. 1. APPROVAL OF MINUTES of October 11, 18 and 25, 2011. Staff recommendation: Council approve the minutes. 2. WRITTEN COMMUNICATIONS A. Memorandum from Councilmember Ramirez requesting an excused absence from the March 1, 2012 City Council Workshop meeting. Recommendation: Council excuse the absence. 3. ORDINANCE NO. 3227 OF THE CITY OF CHULA VISTA AMENDING CHAPTER 15.12, GREEN BUILDING STANDARDS, OF THE CHULA VISTA MUNICIPAL CODE, ADDING SECTION 15.12.030, COOL ROOF (SECOND READING AND ADOPTION) Staff recommendation: Council adopt the ordinance. RESOLUTION NO. 2012-051 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE SUMMARY VACATION OF CERTAIN DRAINAGE, ACCESS, UTILITY AND SLOPE EASEMENTS ADJACENT TO BONITA ROAD Staff recommendation: Council adopt the resolution. ACTION: Mayor Cox moved to approve staffls recommendations and offered Consent Calendar items 1 through 3, and 5, headings read, text waived. Councilmember Bensoussan seconded the motion, and it carried 4-0. ITEMS REMOVED FROM THE CONSENT CALENDAR 4. RESOLUTION NO. 2012-050 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE SUBMITTAL OF AN APPLICATION FOR A HOUSING RELATED PARKS GRANT FROM THE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT ACTION: Mayor Cox moved to adopt Resolution No. 2012-050, heading read, text waived. Councilmember Ramirez seconded the motion, and it carved 3-0-1, with Deputy Mayor Castaneda abstaining. PUBLIC COMMENTS Elroy Kihano, Chula Vista resident, commented on the Council's recent approval of funding for the Third Avenue streetscape improvements and construction of a park, and questioned why public services such as the City's graffiti abatement program and police and fire safety services are not being restored. Willard Howard, Chula Vista resident, asked for clarification about the construction start date of the Orange and Fourth Avenue park. Public Comments were continued following item 9. COUNCILMEMBERS' COMMENTS ACTION: Councilmember Ramirez moved to support an endorsement of the International Friendship Games to be held at Mater Dei High School and the Chula Vista Olympic Training Center, June 30, 2012. Deputy Mayor Castaneda seconded the motion, and it carried 4-0. Councilmember Ramirez left the meeting at 4:13 p.m. The balance of item 9 was addressed after item 8. PUBLIC HEARINGS 6. PUBLIC HEARING ON CHULA VISTA'S PORTION OF THE REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM Notice of the hearing was given in accordance with legal requirements, and the hearing was held on the date and at the time specified in the notice. Mayor Cox opened the public hearing. There being no members of the public who wished to speak, Mayor Cox closed the public hearing. ACTION: Mayor Cox moved to adopt the following Resolution No. 2012-052, heading read, text waived. Councilmember Bensoussan seconded the motion, and it carried 3-0- 1, with Councilmember Ramirez abstaining due to a potential property-related conflict of interest. RESOLUTION NO. 2012-052 OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADOPTING THE TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF PROJECTS FOR FISCAL YEARS 2012/2013 THROUGH 2016/2017 FOR INCLUSION IN THE REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM, PROVIDING THE CERTIFICATION AND INDEMNITY STATEMENTS NECESSARY TO OBTAIN TRANSNET FUNDS AND PROGRAMMING $535,873 IN FUNDS FROM COMPLETED PROJECTS OTHER BUSINESS (Continued) 7. CITY MANAGER'S REPORTS City Manager Sandoval announced that staff would be conducting community meetings to discuss facility use options for the proposed land swap between the City and Calvary Chapel Church and Cottonwood Park. Page 3 -Council Minutes March 27, 2012 1-3 He also stated that staff would present the Council with a proposed contract between the City and South Bay Community Services for continued operation of the Domestic Violence Response Team. 8. MAYOR'S REPORTS Mayor Cox announced that a summary of department accomplishments in 2011-2012 would be made available on the City's website. 9. COUNCILMEMBERS' COMMENTS (Continued) A portion of item 9 was taken out of order and addressed after Public Comments. Deputy Mayor Castaneda requested and there was a consensus of the majority of the Council to place an item on the next agenda to consider a resolution to support a proposed bill to ban synthetic drug possession. PUBLIC COMMENTS (Continued) (Some public comments were heard after item 4.) The following members of the public spoke about concerns with a recent resident survey sent to mobilehome park residents by the City, regarding the assessment of administrative fees for rent control services: • Penny Vaughn, Chula Vista resident, representing mobilehome residents • Bill Schlegel, Chula Vista resident, representing Homeowners Association of Terry's Park • Margaret Daniels, Chula Vista resident • Sandra Miller, Chula Vista resident • Irene Bourke, Chula Vista resident, representing mobilehome owners • Gary Mayo, Chula Vista resident, representing Chula Vista Mobilehome Residents Association ^ Judith Mayo, Chula Vista resident, representing Chula Vista Mobilehome Residents Association • Fred Dufresne, Chula Vista resident, representing mobilehome owners • Jim Matney, Chula Vista resident, representing mobilehome residents The following members of the public submitted speaker slips but were not present or declined to speak: • Sheldon Goldie, Chula Vista resident, declined to speak • William Watkins, Chula Vista resident, was not present • John Peterson, Chula Vista resident, representing mobilehome owners was not present Mayor Cox announced that the matter would be referred to staff.
