APPROVING AGREEMENT BETWEEN THE CITY O~' CHULA JI,S'I'A A.AYD
MRS. VIRGIL S. KIPP TO DEDICATE A PORTION OF EAST OXFORD
STREET AND TO PROVIDE REQUIRED PUBLIC IMPROVEMENTS
AND AUTHORIZING THE MAYOR TO E'~ECUTE SAME
The City Council of the City of Chula. Vista. does hereby
resolve as follows:
That that certain agreement between the City of Chu:La Vista,
a municipal corporation, and MRS. VIRGIL S. KIPP to dedicate a portion
of East Oxford Street and to provide for the required public improvements,
dated the 24th day of
January 19 67 a cope of. wh1 cli
is attached hereto and incorporated herein,, the same as though f:~7.7_~y~
set forth herein be, and the same is he.r_eby approved.
BE IT FURTHER RESOLVED that the Ma~ror of the City of Chula.
Vista be, and he is hereby authorized and directed to execute said
agreement for and on beha]_f of said City,

STREET AND TO PROVIDE FOR THE REQUIRED
PUBLIC IMPROVEMENTS
THIS AGREEMENT, made and entered into this 24th- day of
January , 1967, by and between THE CITY OF CHULA VISTA, a
municipal corporation, hereinafter called "City", and MRS. VIRGIL S.
KIPP, an individual, hereinafter called "Owner";
W I T N E S S E T H
WHEREAS, the City of Chula Vista has heretofore required,
as a condition of the approval of the final subdivision map of that
certain subdivision to be known as Chula Vista Gardens Unit No. 2,
that an eight foot (8') strip south of the str-et centerline of East
Oxford Street beyond the boundaries of said subdivision be acquired
and improved by the Subdivider, and
WHEREAS, the City desires, at the present time, to fully
improve said street known as East Oxford Street to the ultimate
width of twenty feet (20]) south of said street centerline, and
WHEREAS, the Owner of said property is willing to dedicate
said twenty foor (20') of street right-of-way, provided that the
public improvements not be required to be installed at a cost to
Owner.
NOW, THEREFORE, IT IS MUTUALLY AGREED by and between the
parties hereto, in consideration of the premises and for other good
and valuable consideration, receipt of which is hereby acknowledged,
as follows:
1. Owner, MRS. ,VIRGIL S. KIPP, agrees to dedicate a twenty
foot (20') strip south of the street centerline of East
Oxford Street, as shown on the final map of that certain
subdivision known as Chula Vista Gardens Unit No. 2, and
more particularly described in Exhibit "A" attached hereto
and by this reference made a part hereof the same as if
set forth in full herein, for street purposes.
2. The City of Chula Vista hereby agrees to complete, or
cause to be completed, the required public improvements of
said portion of the right-of-way of East Oxford Street,
being an asphaltic concrete pavement with a berm.
3. It is further agreed that said improvements shall be
installed by the Subdivider of Chula Vista Gardens Unit No. 2
at the same unit price of the balance of the improvement of
East Oxford and at no cost to Owner.
IN WITNESS WHEREOF the parties hereto have set their hands
the day and the year first hereinabove set forth.
