HomeMy WebLinkAboutReso 2012-113RESOLUTION NO. 2012-113 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REJECTING THE BIDS OF THE FIRST AND SECOND APPARENT LOW BIDDERS AS NON- RESPONSIVE, ACCEPTING REMAINING BIDS, AWARDING A CONTRACT FOR THE "DEL MAR AVENUE IMPROVEMENTS FROM NAPLES STREET TO OXFORD STREET (STL385)" PROJECT TO HTA ENGINEERING AND CONSTRUCTION, INC. OF SAN DIEGO, CALIFORNIA IN THE AMOUNT OF $620,610 CONTINGENT UPON APPROVAL OF PROJECT FUNDING IN THE PROPOSED FISCAL YEAR 2012/2013 CAPITAL IMPROVEMENT PROGRAM, WAIVING COUNCIL POLICY NO. 574-01, AND AUTHORIZING THE EXPENDITURE OF ALL AVAILABLE CONTINGENCY FUNDS NOT TO EXCEED $94,390 WHEREAS, on May 16, 2012, the Director of Public Works received six (6) sealed bids for the "Del Mar Avenue Street Improvements from Naples Street to Oxford Street (STL385)" Project; and WHEREAS, the project consists of the sidewalk improvements and related street work along Del Mar Avenue from Naples Street to Oxford Street in the City of Chula Vista; and WHEREAS, the following six (6) bids were received and reviewed for responsiveness to the bid solicitation, as follows: BID ACTUAL BID AMOUNT AMOUNT DETERMINATION OF BID (At Bid (Corrected for CONTRACTOR RESPONSIVENESS O enin Math Errors Portillo Concrete Inc., Lemon Mathematical Error. However, bid was determined to be non- responsive because analysis of bid shows that Contractor will not perform at least 50% of the work with his or her own or anization. HTA Engineering and Construction Actual lowest responsive bid $620,610 No Math Errors Inc., San Die o, CA Tri-Group Construction & Responsive $640,000 No Math Errors Develo ment, ]nc., San Die o, CA Palm Engineering Construction Responsive $646,225 No Math Errors Com an ,Inc., San Die o, CA New Century Construction Inc., Mathematical Error $683,100 $678,100 Lakeside, CA Resolution No. 2012-113 Page No. 2 WHEREAS, staff reviewed the appazent lowest bid submitted by Portillo Concrete Inc., and determined that the bid is non-responsive because the Contractor's total bid amount was incorrect due to a mathematical error, resulting in Portillo Concrete, Inc.'s bid actually being the fourth lowest bid; and WHEREAS, staff reviewed the apparent second lowest bid submitted by Latco Construction Inc. and determined that the bid is non-responsive due to a mathematical error and because the Contractor's bid does not comply with Section 2-03 of the Project Specifications, which requires that the Contractor perform at least 50% of the contract work with his or her own organization; and WHEREAS, staff then reviewed the third lowest bid submitted by HTA Engineering and Construction, Ina ("HTA") and determined that the Contractor's bid package is complete, with no errors or omissions; and WHEREAS, HTA has listed two Woman Business Enterprises (WBE) and one MBE as subcontractors for the project; and WHEREAS, the low bid by HTA Engineering and Construction, Inc. of $620,610 is below the Engineer's estimate of $680,000 by $59,390, or approximately 8.7%; and WHEREAS, this contractor has satisfactorily completed several projects for the City and their Contractor's License No. 798372 is current and active; and WHEREAS, the proposed Fiscal Year 2012/2013 Capital Improvement Program (CIP) budget includes proposed HUD Section 108 Loan funding of $840,000 for construction of the proposed street improvements; and WHEREAS, staff recommends award of the construction contract to HTA Engineering and Construction, Inc. of San Diego, California in the amount of $620,610 contingent upon approval of project funding in the proposed 2012/2013 CIP budget; and WHEREAS, in order to approve change orders as necessary, staff is requesting City Council waive Council Policy No. 574-01. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby reject the bids of the first and second low bidders as non-responsive, accept remaining bids, and awazd a public works contract to HTA Engineering and Construction, Inc. of San Diego, California in the amount of $620,610 contingent upon approval of project funding in the proposed Fiscal Year 2012/2013 Capital Improvement Program. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby waive Council Policy No. 574-01 and authorizes the Director of Public Works to expend all available contingency funds in an amount not to exceed $94,930.
