ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with. the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION The Police Department entered into an agreement with the Office of National Drug Control Policy in 1996 to be the fiscal agent for the California Border Alliance Group (CBAG). CBAG is part of the Southwest Border High Intensity Drug Trafficking Area (SWHIDTA). 8-1 JULY 10, 2012, Item ~d" Page 2 of 2 In essence, the City receives full funding, plus a 4% administrative fee, to hire and administer salary and benefits for CBAG positions. To date, there are currently 18 CBAG positions with the City of Chula Vista that are fully funded from the Office of National Drug Control Policy (ONDCP). As an authorized fiduciary for CBAG, the Police Department may in some cases be the purchaser of certain services, supplies, equipment or purchase of evidence/information funds on behalf of another agency. Currently, the Immigration and Customs Enforcement (ICE) receives their HIDTA funding directly from ONDCP. However, ICE is occasionally awarded by the CBAG Executive Board prior year funds which cannot go directly to ICE. The CBAG Executive Board has awarded $45,000 to ICE for purchase of evidence/information for highly sensitive HIDTA operations, and the Police Department will be the fiscal agent for this funding. ICE has a confidential payment system that meets or exceeds the HIDTA Program Guidance and has agreed to provide any backup documentation necessary to satisfy an auditor in the case of an audit. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will .result in a one-time appropriation of $45,000 to the supplies and services budget of the Police Grant Fund. The funding from the Office of National Drug Control Policy will fully offset these costs, resulting in no net fiscal impact to the General Fund. ONGOING FISCAL IMPACT There is no ongoing fiscal impact for this one-time appropriation. ATTACHMENTS None. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby accept $45,000 from the Office of National Drug Control Policy and appropriate said funds to the supplies and services category of the Police Grant Fund.
