RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
OPPOSING SENATE BILL N0. 876 REGARDING PARKS AND RECREATIONAL
FACILITIES TO SERVE NEIGHBORHOODS OR SUBDIVISIONS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the legislature of the State of California, in
1963, adopted Assembly Bill No. 1150 which authorized cities and
counties to adopt appropriate ordinances which would allow the im-
position of a requirement for dedication of land or payment of fees
in lieu thereof or a combination of both for park sites in new sub-
divisions, and
WHEREAS, said legislation constituted a forward-looking
and progressive attempt by the legislature to provide proper guide-
lines which would satisfy the adverse decisions in such cases as
the case of Kelber vs. Uplands, and would, if properly implemented,
provide vitally needed open space and park sites, the need for which
is created by the rapid expansion of subdivision growth in all cities
in the State of California, and
WHEREAS, the fact that only a small percentage of the of
the communities in the State have taken advantage of this legislation
in no way is indicative of any lack of need for such dedications, and
WHEREAS, it should be the aim of the legislature, through
cooperative efforts with the League of California Cities, to improve
upon the existing legislation so as to develop a truly workable pro-
gram of park site dedications, and
!n'~:EREAS, the provisions of Senate Bill 876, which completely
repeals assembly Bill No. 1150 and the guidelines set forth in Sec-
tion I~'c~ 11546 of the Business and Professions Code, is a step back-
ward and a failure to recognize the problems of our growing urban
communities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that said Council urges the State legislature to
defeat Senate Bill No. 876, and to work closely with the League of
California Cities in the improvement of legislation requiring the
dedication of park sites.

BE IT FURTHER RESOLVED that the City Clerk of the City
of Chula Vista be, and he. is hereby directed to forward certified
copies of this resolution to all members of the legislation of the
County of San Diego, and to the League of California Cities.
