HomeMy WebLinkAboutReso 1967-4395RESOLUTION N0. 4395 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA OPPOSING SENATE BILL NO. 615, AND ASSEMBLY BILL N0. 1310, PLACING CABLE TELEVISION SERVICE UNDER THE JURISDICTION OF THE PUBLIC UTILITIES COMMISSION The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City of Chula Vista has heretofore granted a non-exclusive franchise to Mission Cable TV, Inc., to provide cable television service to all residents within the City of Chula Vista, and WHEREAS, said company has operated to the satisfaction of the City of Chula Vista for more than two years, the provisions of said franchise in all respects and restricted by the Federal Communications Com WHEREAS, the City of Chula Vista feels to control the operation of the cable television munity both as to quality of service and cost to the City, and and has adhered to except where limited nission, and that it is best able service in this com- the residents within WHEREAS, any attempt to place such controls in the hands of the Public Utilities Commission or any other administrative board, in- cluding the Federal Communications Commission, would constitute a further attack upon the principle of home rule and would fail to offer the same safeguards to the citizens of Chula Vista as can be obtained through the regulations imposed by the franchise issued by the City Council of the City of Chula Vista, and WHEREAS, there is no question that cable television operations are strictly local and have been in the past and are presently being adequately regulated by the cities and counties under the provisions of local ordinances which may be appropriately amended from time to time in order to meet the changing circumstances within the local communities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that said Council, on behalf of themselves and the residents within the City of Chula Vista who are subscribing to the community antenna service of Mission Cable TV, Inc., under the franchise issued by the City of Chula Vista, does hereby strongly urge the Senate Public Utilities Committee to reject Senate Bill No. 615, and the Assembly Committee on Public Utilities and Corporations to reject Assembly Bill No. 1310 in light of the fact that the cable television industry is adequately regulated by the local communities and policing said operations under the jurisdiction of the Public Utilities Commission would constitute a further intrusion into the area of home rule. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to send a copy of this resolution to the chairman of the Senate Public Utilities Committee, the Honorable Senator Danielson, to the chairman of the Assembly Committee on Public Utilties and Corporations, the Honorable Assemblyman Badham, and to all members of the legislative delegation of San Diego County.
