HomeMy WebLinkAboutReso 1966-4280 RESOLUTION N0. 4280 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ELECTING TO PROCEED UNDER THE PROVISIONS OF THE PUBLIC SERVICE EASEMENT VACATION LAW OF THE STATE OF CALIFORNIA, DECLARING THE INTENTION OF THE CITY COUNCIL TO VACATE A DRAINAGE EASEMENT LOCATED AT THE SOUTHWEST CORNER OF FOURTH AVENUE AND SHASTA STREET, AND FIXING A TIME AND PLACE FOR HEARING THEREOF The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the easement for drainage purposes, .accepted by the City Council of the City of Chula Vista by Resolution No. 1828, dated the 13th day of March, 1956, is no longer necessary due to the recent improvement of Fourth Avenue which included drainage facilities in Fourth Avenue and Shasta Street, and WHEREAS, the City Council of the City of Chula Vista has determined that the public interest and convenience of said City re- quire the vacation of said easement. NOW, THEREFORE, BE IT RESOLVED that it is the intention of the City Council to order the vacation of that portion of Lot 3 of Brown and Woolery No. 1 according to Map thereof No. 3322, filed October 28, 1955 in the Office of the County Recorder of San Diego County, and more particularly described as follows: Commencing at the Northwesterly corner of said Lot 3; thence along the Northerly line of Lot 3 North 71°19'08" East 45.42-feet to the true point of beginning; thence South 45°17'20" East 72.68 feet to a point in the Easterly line of said Lot 3 which bears North 18°43'20" West 26.47 feet from the Southeasterly corner of Lot 3; thence along the Easterly line of Lot 3 North 18°43'20" West 46.99 feet to the beginning of a tangent circular curve with a radius of 18 feet; thence Northwesterly, Westerly, and Southwesterly along the arc of said curve a distance of 28.26 feet and through a central angle of 89°57'32"; thence tangent to aforementioned curve and along the Northerly line of said Lot 3 South 71°19'08" West 14.51 feet to the true point of beginning. BE IT FURTHER RESOLVED that the Council of the City of Chula Vista hereby elects to proceed in making said vacation under the provisions of the Public Service Easement Vacation Law of the State of California, and hereby fixes Tuesday, the 17th day of January, 19b7, in the Council Chambers of the Civic Center, 276 Guava Avenue, .Chula Vista, California as the time and place for hearing all persons interested in or objecting to the proposed vacation. -1- BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to cause a copy of this resolution to be published once in the Chula Vista Star News, a news- paper of general circulation published within the City of Chula Vista, and to cause notices of the passage of this resolution to be posted in the manner and form required by law.
