RESOLUTION NO. 4446
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND
ANGE ~~?~vDRA, A MARRIED NIAN, FOR THE PURCHASE AND SALE OF
CERTAIiv REAL PROPERTY IN THE CITY OF CHULA VISTA
AND AUTHORIZING THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain agreement between the City of Chula Vista,
a municipal corporation, and Ange Mandra, a married man, for the
purchase and sale of certain real property in the City of Chula Vista
dated the 20th day of
June
, 196 , a copy of which
is attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement far and. on behalf of said City.

AGREEMENT FOR PURCHASE AND SALE OF
REAL PROPERTY
THIS AGREEMENT, made and entered into this 2~th day of
June 1967, by and between the CITY OF CHULA VISTA, a municipal
corporation, hereinafter referred to as "Purchaser" and ANGE MANDRA, a
married man, hereinafter referred to as "Seller",
W I T N E S S E T H
WHEREAS, Seller is the owner of certain real property hereinafter
described, being parcels of record located in the City of Chula Vista, County
of San Diego, State of California, described as lots or a portion of a lot
or lots of record, and
WHEREAS, Seller wishes to sell, and Purchaser wishes to purchase
said real property to be used for park property in the City of Chula Vista,
County of San Diego, State of California, and
WHEREAS, the parties hereto have reached an agreement which they
now wish to reduce to writing.
NOW, THEREFORE, IN CONSIDERATION OF THE PREMISES contained herein
and for other good and valuable consideration, receipt of which is hereby
acknowledged, the parties hereto agree as follows:
1. Seller agrees to sell, and Purchaser agrees to purchase that
certain real property situate in the -City of Chula Vista, County of San Diego,
State of California, more particularly described as:
All that portion of Lots 28 and 29 in Quarter Section 122 of
Chula Vista, according to Map thereof No. 505 filed in the
office of the County Recorder of San Diego County, March 13,
1888, bounded and described as follows:
Beginning at a point on the center line of "K" Street (formerly
3rd Street per said Map 505) distant thereon North 71°,.45'18" East
(according to recorded Map No. 5634, filed in the Office of said
County Recorder) a distance of 1047.50 feet from the intersection
of First Avenue (formerly 5th Avenue per said Map 505) and "K"
Street; thence North 18°17'00" West, according to said Map 5634,
a distance of 181.27 feet to the TRUE POINT OF BEGINNING; thence
continuing North 18°17'00" West, a distance of 335.00 feet to
the Southerly line of that land described in deed to David Hall-
e strom and George Kerr dated November 4, 1929 and recorded in
Book 1705, Page 62 of Deeds; thence North 71°46'09" East, accord-
ing to said Map 5634, along said Southerly line, a distance of
236.02 feet to the Easterly line of said Lots 28 and 29; Thence
South 18°25'05" East, according to said Map 5634, along said
Easterly line, parallel with and 40 feet Westerly of the Easterly
line of said Quarter Section 122, a distance of 335.00 feet;
thence South 71°46'09" West a distance of 236.81 feet to the
TRUE POINT OF BEGINNING
2. Tke purchase price therefor shall be the sum of NINE THOUSAND
ONE HUNDRED and no/100 DOLLARS ($9,100.00).
3. Purchaser agrees to deposit said amount in an escrow covering
the sale upon approval of this .agreement by the City. Council of the City of
Chula Vista. Seller agrees to share all normal costs of escrow and to pro-
vide a good and valid title policy for said property.

4. Purchaser further agrees to provide an appropriate access
in the width of twenty feet (20') from Hilltop Drive to that certain
property owned by Seller located adjacent to and westerly of the property
to be purchased. .City agrees to provide said access and required improve-
ments over the existing drainage channel in such a manner so as to allow
development of the access way by Seller, except that the City will con-
struct the necessary improvements over the existing drainage channel.
Said improvements shall be installed in accordance with plans and speci-
fications approved by the City Engineer and at such time as mutually
agreed upon by the parties to this agreement within one (1) year of the
date of close of escrow, and shall be a part of the consideration for
the sale of this property.
5. This agreement shall bind, and enure to the benefit of, the
heirs, executors, administrators, successors and assigns of the parties.
IN WITNESS WHEREOF, the parties hereto have executed this agree-
ment this 20th day of June 1967.
