RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
OPPOSING ASSEMBLY BILL N0. 902 IMPOSING MANDATORY REQUIRE-
MENTS UPON CITIES AND COUNTIES TO PROVIDE CERTAIN EQUIPMENT
FOR FULL-TIME POLICE OFFICERS
The City Council of the City of Chula Vista does hereby resolve as
follows:
WHEREAS, Assembly Bill No. 902 would require every city and every
county to provide its full-time police officers with equipment necessary for
their safety including, but not limited to, the following: suitable firearm,
holster, belt and ammunition, nightstick, handcuffs, and foul-weather garments,
and
WHEREAS, such mandatory requirements would be a clear invasion of
the principle of home rule and would adversely affect the adopted budget of
the City of Chula Vista and of all other cities, and
WHEREAS, experience has shown that imposing the requirement for the
purchase of said equipment upon the police officer, either as a direct expense
or as an allowance granted as a fringe benefit would insure the proper care
and maintenance of said equipment by said officer, and has the effect of im-
posing said responsibility upon the individual officer, and
WHEREAS, the bill would in no way assure the municipalities of any
support from the State to offset the substantial monetary burden which would
be imposed on them by its passage.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Chula Vista that said Council, in the interests of tax savings and the preser-
vation of the principal of home rule, does hereby strongly urge the Assembly
Committee on Criminal Procedure to recommend against the passage of this bill,
and that said Council does hereby urge the defeat of this bill by both the
Assembly and Senate of the California State Legislation.
BE ZT FURTHER RESOLV~A that the C~.ty Clerk of the City of Chula Vista
be, and he is hereby directed to forward a certified copy of this resolution
to the Assembly Committee on Criminal Procedure and to the legislative delegation
of the County of San, Diego.
