HomeMy WebLinkAboutReso 1967-4435RESOLUTION N0. 4435 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA URGING PASSAGE OF ASSEMBLY BILL N0. 2395 AND ASSEMBLY CON- STITUTIONAL AMENDMENT N0.7~, PROVIDING FOR THE IMPOSITION OF A 2% TAX UPON TELEPHONE COMPANIES' REVENUES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the telephone companies in the State of California are presently exempt from the payment of any franchise fees, which franchise fees are imposed upon all other private utilities utilizing the public rights-of- way, and WHEREAS, Assembly Bill No. 2395 and Assembly Constitutional Amend- ment No. 74 would restore revenues presently lost to the cities, which other private utilities are required to pay, and would again place the telephone utilities in the same position as all other utilities with respect to payment of a fee for the valuable privilege of using public rights-of-way to engage in business, and WHEREAS, Assembly Bill No. 2395 would impose a 2% tax on the regular monthly recurring charges paid for intrastate telephone service and would be administered by the State Board of Equalization, to be returned to cities on the basis of incorporated population and to counties on the basis of population in the unincorporated territory, and WHEREAS, if Assembly Constitutional Amendment No. 74 were approved, said Assembly Bill No. 2395 would cease to be operative and the constitutional amendment would impose a 2% quarterly tax on telephone companies' revenues re- ceived from regular monthly recurring charges paid for intrastate telephone services, and distribution of the revenues would be the same as provided under the provisions of Assembly Bill No. 2395. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista, on behalf of themselves and the taxpayers of this community, do hereby urge the Assembly Committee on Revenue and Taxation to recommend the passage of Assembly Bill No. 2395 and Assembly Constitutional Amendment No. 74 and that the Legislature of the State of California and the Governor of the State of California adopt said legislation. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to forward certified copies of this resolution to the Chairman of the Assembly Committee on Revenue and Taxation, the Honorable John G. Veneman, to the Governor of the State of California, the Honorable Ronald Reagan, and to all members of the legislative delegation of the County of San Diego. Presented by C` ._ Zf Fred A.
