Motion carried. 2 NEW BUSINESS: 1 A Review of ordinance of the City of Chula Vista amending Chapter 15..26 of the Chula Vista Municipal Code and adding Section 15 26.030, Increased Efficiency Standards. 3 MEMBERS COMMENT'S/CHAIRMAN'S COMMENT'S/REPORTS Chair Buddingh reminded the committee that there were two vacancies to fill; if they knew of anyone with a building construction background please encouraged them to apply, Mr EI-Khazen also noted he would be interviewing a potential candidate possibly next week. 5 BUILDING OFFICIAL'S COMMENT'S/REPOR'TS: Building Official, Lou EI-Khazen, presented the proposed ordinance and gave a power point presentation providing background information on the proposed increased energy efficiency standards, Ed Batchelder, Advance Planning Manager gave an explanation of the energy credit savings option and how it will apply to projects in Chula Vista within Sectional Planning Areas (SPA).. Scott Molloy, with the Building Industry Association commented on the financial impact to the building industry and home prices and asked that it be voluntary accompanied with incentives such as expedited permitting process. After deliberation, the Board of Appeal and Advisors unanimously recommended that City Council adopt the proposed ordinance.. MINUTES TAKEN BY: ROSEMARIE RICE, SECRETARY DEVELOPMENT SERVICES DEPARTMENT -BUILDING DIVISION I BOARD OF APPEALS AND ADVISORS Meeting Date: 10/11/2010 Subject: Ordinances adopting the vazious 2.010 California building codes Submitted By: Building Official Fire Marshal/Deputy Fire Chief' The California Building Standazds Commission has mandated that jurisdictions within the State of California stazt enforcing the 2010 Editions of the Califoxnia building codes on Januazy 1, 2011. the adoption of Califoxnia building codes is a routine action undertaken by the City in response to newly State adopted building codes, This action will allow the City to incorporate appropriate local amendments into the enforcement program RECOMMENDAIION: Recommend to City Cotmcil the adoption of the various 2010 Editions of the California building codes DISCUSSION: As mandated by the California Building Standards Commission (CBSC), jurisdictions within the State shall begin enforcing the 2010 Editions of the Califoxnia building codes on .January 1, 2011 Every three years, the State adopts and amends the newest model codes published by the various independent code-developing bodies. New State building codes take effect one hundred and eighty (180) days after they are published to allow local jurisdictions time to adopt local amendments to the State building codes before they take effect. Local amendments cannot be less restrictive than the State building codes and must be based on findings that the amendments axe necessary because of local climatic, geological or topographical conditions Local amendments are not effective until the amendments have been filed with the CBSC the majority of the proposed local amendments exist in our Municipal Code as amendments to the currexit building codes adopted by the City and are carried forward as the City adopts the 2010 codes. Staff is proposing new local amendments to the 2.010 Califoxnia Green Building Standards Code (2010 CGBSC) and the 2010 Califoxnia Fire Code (2.010 CFC) Ihese local amendments will be discussed later in this report.. All but two of the 2010 Califoxnia codes aze updated editions to the current codes that aze enforced locally and throughout the state and therefore, it should not be difficult fox staff and the industry to incorporate into their cturent practices. The 2010 Califoxnia Residential Code (2010 CRC) is a completely new code to California and the 2010 CGBSC, which was entirely voluntary, now contains mandatory and voluntary requirements for both residential and non- residential. the following are brief discussions on the various ordinances adopting the 2010 building codes: Proposed Ordinance "A" -Administrative Provisions for the Iechnical Codes ' This ordinance proposes minor amendments to Municipal Code Chapter 15,06, Administative C:\Documents and Settings\loueUVly Documents\2010 Building Codes\BOAA 2010 Codes Adoption doc Board of Appeals and Advisors Page 2 of 4 ; Meeting Date 10/11/2010 Provisions for the Iechnical Codes. The proposed amendments remove the need to have to amend this Chapter every time new codes are adopted and revise the definition of Building Official due to the elimination of the position of Assistant Director of Planning and Building Proposed Ordinance "B" - 2010 California Building Code The proposed ordinance simply adopts the 2010 California Building Code and cazries forward existing local amendments to the current Building Code adopted by the City., Proposed Ordinance "C" - 2010 California Residential Code The 2010 CRC is a new code to California and is based on the 2009 International Residential Code, published by the International Code Council, with State amendments.. the 2010 CRC applies "to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one- and two-family dwellings and townhouses not more than three stories above grade plane in height with a separate means of egress and their accessory structures." By incorporating prescriptive design methods, design tables and illustration drawings, the CRC simplifies the design and construction oflow-rise one- and two-family dwellings and townhouses,. New residential buildings and their accessory structures that fall outside the scope of the CRC will have to comply with the 2010 California Building Code. the CRC requires all new one- and two-family dwellings and townhouses to have fire sprinkles systems Ihis is the fast time where a State building code has such requirement on one- and two-family dwellings. the cost of a residential sprinkler system ranges from $1..50 to 2,50 per square foot. Additions and remodels to existing one- and two-family dwellings and townhouses that do not have an existing fire sprinkler system are exempt fiom this requirement unless other ~ State or local codes trigger it. Staff' is not proposing any local amendments to the 2010 CRC,. Proposed Ordinance "D" - 2010 California Referenced Standards Code The proposed ordinance simply adopts the 2010 California Referenced Standards Code Staff is not proposing any local amendments to the code, Proposed Ordinance "E" - 2010 California Green Building Standards Code As part of the implementation of Measure # 4 of the Climate Change Working Group, on October 6, 2009, Council adopted Ordinance 2.009-3140 adding Chapter 15.12, Green Building Standards (GBS), to the Municipal Code. the City's GBS is based on the early adoption of the State Housing and Community Development's (HCD) green building standards found in the all- voluntary 2008 California Green Building Standards Code (08 CGBSC), and requiring them on all new residential and non-residential buildings and additions and alterations to existing residential and non-residential buildings. the proposed ordinance amends MC Chapter 15 12 by adopting the 2010 CGBSC and local amendments, the 2010 CGBSC contains mandatory and voluntary requirements that apply to both residential and non-residential buildings the 2010 CGBSC applies only to new buildings and staff is proposing an amendment to also require it on additions, alterations and tenant improvements to Board of Appeals and Advisors Page 3 of 4 Meeting Date 10/11/2010 existing buildings. Ihis proposed amendment will bring the scope of the 2010 CGBSC to be more in-line with the scope of the City's current GBS.. Amending the code to require it on additions, alterations and tenant improvements created the need to amend other sections of the code where the requirements are unreasonable for these types of projects Another proposed amendment to the 2010 CGBSC, in older to bring it in-line with the City's current GBS, is the addition of a subsection establishing the effective date of the residential indoor water use measures to be .January 1, 2011, the same date this code takes effect, instead of the date established by HCD which is July, 1, 2.011. Ihese measures are currently required by the City's GBS HCD delayed the effective date of these measures due to a concern that the products (low-flow fixtures, showerheads and toilets) may not be available to meet market demand when the code gets adopted statewide. These products have been required in Chula Vista since November of 2009 and there are no indications that local suppliers are having difficulty meeting demand In addition, due to the current slowdown in construction activity, staff does not anticipate a large increase in local demand between now and July 1, 2011. Proposed Ordinance "F" - 2010 California Mechanical Code The proposed ordinance simply adopts the 2010 California Mechanical Code. Staff is not proposing any local amendments to the code ' Proposed Ordinance "G" - 2010 California Electrical Code The proposed ordinance simply adopts the 2010 California Electrical Code and carries forward existing local amendments to the current Electrical Code adopted by the City, Proposed Ordinance "H" - 2010 California Plumbin Code I, The proposed ordinance simply adopts the 2010 California Plumbing Code and carries forward existing local amendments to the current Plumbing Code adopted by the City. Proposed Ordinance "I" - 2010 California Fire Code The proposed ordinance adopts the 2010 California Fire Code and carries forward existing local amendments to the current Fire Code adopted by the City Additionally, two new amendments j have been set forth therein. the first new amendment adopts the California State Fire Marshal's Guidelines for the installation of Solar Photovoltaic Systems, These provisions will ensure safety for firefighters when working around this technology; and afford operational access to key building features, such as the roof. the second new amendment aligns the California Fire Code's requirements for `Artwork' to match the requirements of the Life Safety Code Ihis alignment is also in concert with a majority of the fire departments throughout San Diego County. "Fue Hazard" means anything that increases or could cause an increase of the hazazd or menace of fire to a greater degree than customazily recognized as normal by persons in the public service regularly engaged in preventing, suppressing or extinguishing fire or any thing or act which could obstruct, delay, hinder or interfere with the operations of the fine department or egress of occupants in the event of fire. "Fire Service Features" is a general term inclusive of al] other terms such as driveway, fue lane, public street, private street, parking lot, lane and access roadway This Section 15.36.015 amends Section 202 of the Fire Code Partion of the California Building Standards Code only by adding those definitions speci_fi_cally_identified in herein. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fue code official, or of a permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable by a fine of not more than the greater of $1,000 dollars or as established by the City of Chula Vista Policy and Procedures Manual for Civil Penalties or by imprisonment not exceeding six (6) months, or both such fine and imprisonment.
