Cole, Director of Public Works / TO: City Attorney :.J l SUBJECT: Sixth Amendment to Agreement between the City of Chula Vista, City of San Diego, the Montgomery Sanitation District and the County of San Diego' Your office is requested to prepare the necessary [X] Resolution; [ ] Ordinance; [ ] Agreement; to be presented to the City Council for action on November 23 , 19 71, on the subject matter. Supporting information: (Use other side if necessary) On February 13, 1964, the City entered into an agreement with the Montgomery Sanitation District permitting joint use of certain sewage facilities in an area generally bet—een "L" Street and Main Street. The agreement specified a particular service area boundary and pro- hibits serving any lands beyond the boundary limits. From time to time the agreement has been amended to allow sewer service to areas not originally covered by the agreement. To date five amendments have been approved. There is now a need to serve an area directly east of Interstate 805 Freeway and south of East Oxford Street. This area was annexed to the City in 1969 and has subsequently been partially developed through subdivision activity. Per terms of the agreement it is now necessary to approve a sixth amendment to permit extension of service to the subject area. Through the request of the Director of Public Works, the County Department of Sanitation and Flood Control, acting as engineers and administrators for the Montgomery Sanitation District, has prepared a Sixth Amendment to the original agreement. The amendment has been reviewed by the Department of Public Works and is recommended for approval by the City Council. Please prepare a resolution for City Council action approving the Sixth Amendment to Agreement among the City of Chula Vista, the Citv of San Diego, the Montgomery Sanitation District and the County of San Diego for the construction, operation and use of sewers. The resolution is further to authorize the Mayor to sign the amendment on behalf of the City. Attachments: 8 copies of Sixth Amendment i Originating Dept. This agreement provides for the inclusion of two additional areas which have been annexed by your city into Service Areas III and IV as defined in the basic agreement. If this agreement appears satisfactory, would you please present it to your Council for execution.
