Cole, Director of Public Works TO: City Attorney SUBJECT: Subdivision Improvement Agreement - Rancho Rios Subdivision, Unit No. 1 Your office is requested to prepare the necessary [X] Resolution; [ ] Ordinance; [ ] Agreement; to be presented to the City Council for action on November 9 , 19 71, on the subject matter. Supporting information: (Use other side if necessary) Rancho. Rios Developers are requesting that the final map of Rancho Rios Subdivision, Unit No. 1 be approved by the City Council subject to the submission of the required bonds within 60 days after approval of the final map by the City Council. The following bonds are required: 1. Faithful Performance bond in the amount of $72,024. 2. Material and Labor bond in the amount of $36,012. 3. Surveying and Monumentation bond in the amount of $1,000. Fees for the subdivision in the following amounts have been deposited: (Receipt #1405 in the amount of $2,686.06) 60% subdivision fee $1,560.00 Recording fee 11.00 Street tree deposit 600.00 Sewer repayment fee 515.06 TOTAL 2,686. The agreements have been executed by the principals of Rancho Rios Developers, a limited partnership, and it is recommended that the Council authorize the Mayor to execute the agreement on behalf of the City. Lindberg, City Attorney SUBJECT: Unanimous Consent Request, Rancho Rios Subdivision, Unit No. 1 (a) Final Subdivision Map (b) Improvement Agreement (c) Control Lots On Friday, October 29, 1971, this office was contacted by the developer of Rancho Rios Subdivision concerning the fact that after checking the agenda for the meeting of Tuesday, Novem- ber 2, 1971, that the final map of Rancho Rios, Unit No. 1, did not appear as an agenda item. It was the understanding of Mr. Odmark, the Developer, (although perhaps mistaken since it is not the usual procedure) in discussions with the office of the City Engineer that the final map which was in complete conformity with the tentative map would be presented to the Planning Commission on Monday, November 1, 1971, for their action and to the City Council on Tuesday, November 2, 1971, for their action. There seemed to be complete agreement that there were no pro- blems aside from the deeds for control lots at the terminus of streets which deeds were presented to the Engineering Department on Thursday, October 28, 1971. The final map, the improvement agreement and the control lots having been presented, it is the desire of the developer to proceed with the approval of the final map at the earliest possible date, i.e., the meeting of Tuesday, November 2, 1971, The Honorable Mayor and City Council November 2, 1971 Page Two so as to allow for the processing of all filing matters re- garding said subdivision. This office checked with the office of the City Engineer and confirmed that all matters as re- quired by law have been fully conformed with at this time the Planning Commission has approved the map at its meeting of November 1, 1971. The Developer indicates that a significant amount of time and money would be lost in the delay of one week on the approval and filing of the subdivision map which is essential to loan committments and filing arrangements. Therefore, it is the recommendation of this office that all things being in order and approved, the final subdivision map and improvement agreement be approved by the City Council and the grant deeds for the control lots be accepted.
