ITEM TITLE: Resolution - City's intention to abate nuisance -
drainage channel maintenance

REQUESTED: Adoption of resolution setting public hearing

BACKGROUND:
On 7- 23 -71, in accordance with City Code Section 26.117(a),
Abatement of Nuisance, notice was sent to owners of 14
parcels adjacent to the Central Drainage Channel, east of
Fifth Avenue, ordering the clean up of the drainage channel
within 20 days. No work has been performed by the property
owners to this date.
La Fontana Associates, owners of the La Fontana Apartments,
have indicated that they would prefer the City perform the
work and bill them for their share of the work.
This resolution calls for a public hearing on this matter
on November 16, 1971.

Your office is requested to prepare the necessary [X] Resolution;
[ ] Ordinance; [ ] Agreement; to be presented to the City Council for
action on October 26 , 19 71, on the subject matter.

On July 23, 1971, in accordance with City Code Section 26.117(a),
Abatement of Nuisance, notice was sent to owners of 14 parcels
adjacent to the Central Drainage Channel, east of Fifth Avenue,
ordering the clean up of the drainage channel within 20 days.
No work has been performed by the property owners to this date.
La Fontana Associates, owners of the La Fontana Apartments, have

In accordance with Section 26.117(b), Abatement by City, it is
requested that you prepare a resolution for adoption by the City
Council setting a public hearing for the Council to determine whethe
the Director of Public Works should proceed to abate the nuisance
