REQUEST FOR COUNCIL ACTION

SUBJECT: Approving Uncontrolled Embankment Agreement for 834 -First
Avenue
Your office is requested to prepare the necessary [X] Resolution;
[ ] Ordinance; [ ] Agreement; to be presented to the City Council for
action on October 5 , 19 71 , on the subject matter.
Supporting information: (Use other side if necessary)
John M. and Patricia B. Sheffield, husband and wife, has paid the
required fees for a permit to place an uncontrolled embankment on
the property at 834 - First Avenue.
In accordance with Section 29.2.23 of Ordinance No. 1163, John M.
and Patricia B. Sheffield have signed a Maintenance Agreement for
Land Development involving uncontrolled embankment. The agreement
states that the fill area shall be designated as an uncontrolled
embankment; the agreement also stipulates that the fill area is not
eligible for building construction without a special soils analysis
and foundation design. In accordance with conditions of the agree-
ment, John M. and Patricia B. Sheffield assumes responsibility for
maintaining the fill area in a safe and sanitary manner.
Please prepare a resolution for City Council action approving
the Uncontrolled Embankment Agreement with John M. and Patricia B.
Sheffield.
The resolution should authorize the Mayor to sign the agreement
on behalf of the City, and instruct the City Clerk to record the
executed document in the office of the San Diego County Recorder.
