HomeMy WebLinkAboutReso 1968-4845 RESOLUTION NO. 4845 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING AND DIRECTING THE CITY ATTORNEY TO FILE A PETITION FOR RECONSIDERATION WITH THE FEDERAL COMMUNICATIONS COMMISSION REGARDING THEIR DECISION RESTRICTING THE EXPANSION OF THE CABLE T.V. SYSTEM IIv' Ti~E CITY OF CHULA VISTA. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, recent Supreme Court rulings have established the principle that community antenna television systems, Cable T.V., is subject to the regulation of the Federal Communications Commission, anal WHEREAS, the Federal Communications Commission has heretofore adopted a decision restricting the expansion of the Mission Cable T.V. Inc. system in the City of Chula Vista, and b4HEREAS, the City Council of the City of Chula Vista has heretofore by Resolution No. 4184 adopted September 6, 1966, registered a strong protest to said decision as an infringement upon the franchise rights of the City of Chula Vista, and WHEREAS, in addition to the consistently announced policy of the City of Chula Vista to provide cable T.V. service to all of the citizens of this community, the effect of this decision is even more detrimental to the community welfare because of its adverse and detri- mental results regarding the undergrounding utility program of the City of Chula Vista, and WHEREAS, if the ruling is not reversed at the present time, all purchasers in new subdivisions in the City of Chula Vista could be potentially deprived of an_y future possibility of cable T.V. service because the cable service is not undergrounded conclzrrent with other utilities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that the City Attorney, George D. Lindberg, be and he is hereby authorized and directed to prepare and submit a petition for reconsideration to the Federal Communications Commission of its decision in Docket No. 16786. Expansion Attached hereto is a copy of a proposed resolution and a letter from Mission Cable T.V. Inc., requesting that this office submit a petition for reconsideration of the decision of the FCC in restricting the expansion of cable T.V. service in the City of Chula Vista. I believe that the City Council has heretofore, on numerous occasions, taken a position in opposition to said decision, and I urge the Council to act by unanimous consent and adopt the attached resolution, so that we may have the petition on file on or before July 29, 1968. The petition will be prepared in accordance with your instructions. You granted our company a franchise and thus have a vested interest in the continued expansion of our system. The present restriction directly affects revenues the City will receive, our ability to provide our service to the areas of the City without it and the City's plan to restrict the placing of TV antennas on roof tops. The Rules and Regulations of the FCC provide for Petitions for Reconsideration to be filed. We would like the Council to consider directing the City Attorney to file such a petition for the benefit of the citizens of Chula Vista. The last day for filing such a petition is July 29, 1968. We would be pleased to appear at a Council meeting to discuss the matter prior to that day.
