RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, OPPOSING THE PROPOSED RULES RELATING TO PUBLIC
HEARINGS AND PROCEDURES FOR LOCATION AND DESIGN OF
FEDERAL AID HIGHWAYS
The City Council of the City of Chula Vista does hereby
resolve as follows:
[9HEF.EAS, the Federal highway Administrator recently filed
rules in the Federal Register regarding public hearings the the process
of locating and designing all Federal-aid highways, and
WHEREAS, these proposed rules would cover all Federal-aid
highways, including Federal-aid secondary, urban extensions, and other
highways under the jurisdiction of local agencies, and
[~7IiEREAS, these rules strike at the heart of the principles
of home rule and effectively transfer control of location and detailed
design from the local jurisdictions to the Federal Highway Administrator
in ~r7ashington, D. C. , and
WHEREAS, the Federal rules provide for unnecessarily lengthy,
involved and expensive proceedings, and
WHEREAS, while the public should be given the utmost oppor-
tunity to be izeard in such matters, highway improvements should not be
stayed by any individual or group that disagrees with the majority
opinion, and
WHEREAS, decisions as to the location and design of city
streets and county roads should be made at the local level.
NOW, THEF.EFORE, BE IT RESOLVED by the City Council of the
City of Chula. Vista does hereby register its strong opposition to the
proposed rules relating to public hearings and procedures for location
and design of Federal aid highways, and does hereby request that the
Federal Highway Administrator immediately rescind said proposed rules
and procedures.
BE IT FURTHER RESOLVED, gnat if the Federal Highway Administrator
does not make such rescission forthwith, that the adoption of the rules
be delayed until a full and complete study can be made on this subject
to develop rules to provide for full public involvement; but which would
not violate the principles of 17ome rule, or allow interminable delay be
dissident persons or groups.
BE IT FLJRTHER RESOLVED that the City Clerk of the City of Chula
Vista be, anti. he is hereby authorized and directed to forward six certi-
fied copies of this resolution to the Federal I~:ighway Administration, and
a copy to the Director of the California Department of Public Works and
to Senators Thomas H. Kuchei and George Murphy, and Conq_ressmen Bob Wilson
and Lionel Van Deerlin.
