RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHtTLA
VISTA, ESTABLISHING AN UNDERGROUND UTILITY DISTRICT
ON A PORTION OF "H" STREET IN THE CITY OF CHULA VISTA
The City Council of the City of Chula Vista does hereby
resolve as follows:
LVHEREAS, by Resolution No. 4938, a public hearing was called
for 7:00 p.m. on Tuesday, the 12th day of November, 1968 in the Council
Chambers of the City of Chula Vista at 276 Guava Avenue in said. City,
to ascertain whether the public health, safety, or welfare requires
the removal of poles, overhead wires and associated overhead structures
and the underground installation of wires and facilities for supplying
electric, communication, or similar or associated service, within that
certain area of the City more particularly described as follows:
Those certain parcels or portions thereof within Quarter
Sections 138 and 123 of Chula Vista, according to Map
thereof Iv'o. 505, filed in the office of the County
Recorder, County of San Diego, State of California,
lying Northerly and Southerly of "H" Street, between
the centerline of_ Third Avenue and the Westerly line
of Hilltop Drive (formerly Sixth Avenue per said Map
505), as shown by the shaded area on the attached
Exhibit "A",
and
WHEREAS, notice of such hearing has been given to all affected
property owners as shown on the last equalized assessment roll and utilities
concerned in the manner and for the time required by law, and
WHEREAS, such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to be heard.
NOW, THEREFOF.E, BE IT RESOLVED that the Council of the City of
Chula Vista hereby finds and determines that the public health, safety
and welfare require the removal of poles, overhead wires and associated
structures, and the underground installation of wires and facilities
f.or supplying electric, communication or similar associated service, and
that, pursuant to Ordinance No. 1128 of the City of Chula Vista, the
above-described area is hereby declared an Underground Utility District,
and is designated as such in the City of Chula Vista. Attached hereto,
marked Exhibit "A", and incorporated herein by reference is a map
delineating the boundaries of said District.
BE IT FURTHEF, RESOLVED that the City Council does hereby fix
Tuesday the 1st day of July 19 69 as
the date on which affected property owners must be ready to~receiT.?e
underground service, and does hereby order the removal of all poles.:-,
overhead wires and associated overhead structures and the underground
installation of iwres and facilities for supplying electric, communication
or similar or associated service within said Underground Utility District
on or before the 1st day of September 19 69,
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed
to notify all affected utilities and all persons owning real property
within said Underground Utility District of the adoption of this resolu-
tion within ten (10) days after the date of such adoption. Said City
Clerk shall further notify said property owners of the necessity that,

if they or any person occupying such property desire to continue to
receive electric, communication or other similar or associated service,
they or such occupant shall, by the date fixed in this resolution,
provide all necessary facility changes on their premises so as to
receive such service from the lines of the supplying utility or utilities
at a new location, subject to the applicable rules, regulations and
tariffs of the respective utility or utilities on file with the Public
Utilities Commission of the State of California as of the date of adoption
of this resolution. Such notification shall be made by mailing a copy
of this resolution, together with a copy of said Ordinance No. 1128 to
affected property owners as such are shown on the last equalized assess-
ment roll and to the affected utilities.
BE IT FURTHER RESOLVED that the City Council hereby finds that
the Underground Utility District herein created is in the general public
interest for the following reasons:
1. That the undergrounding to be accomplished will avoid or
eliminate an unusually heavy concentration of overhead distribution
facilities, and will be accomplished along with a major street widening
project; and
2. That the streets, roads or rights-of-way in the District
are extensively used by the general public and carry a heavy volume of
pedestrian or vehicular traffic.
