RESOLUTION NO. 407;,
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, FINDING COMPETITIVE BIDDING TO BE IMPRACTICAL
FOR THE INSTALLATION OF DRAINP.GE FACILITIES ON WOOD-
LAWN AVENUE, FLOWER STREET, AND RIVERLAWN AVENUE,
AND WAIVING THE FORMAL BIDDING REQUIREMENTS OF SECTION
1109 OF THE CITY CHARTER
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, pursuant to Section 1109 of the Charter of the
City of Chula Vista, the Director of Public Works has heretofore
secured authorization from the City Council to advertise for bids
for the construction of certain drainage facilities in the vicinity
of Woodlawn Avenue, Flower Street and Riverlawn Avenue, and
WHEREAS, after carrying out the bidding procedures as set
forth in said=nction 1109, the Director of Public Works has reported
to the City Council that no bids were received for said -project, and
WHEREAS, the Director of Public Works, in said report, noted
that the dollar amount of said project was relatively small, being
less than $9,000.00, according to the Engineering Estimates, and
that the lack of response to our advertising for bids was probably
the result of the fact that the contractors at the present tine are
extremely busy, and
WHEREAS, the Director of Public Works also noted that the
completion of this project prior to the rainy season is considered
essential, and under the terms of Section 1109 of the Charter, of
urgent necessity for the preservation of_ life, health or property,
and
WHEREAS, it was determined that it would be possible to
obtain contracting services on an informal bidding basis if said
formal bidding requirements were waived.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista, based upon the foregoing facts and reasons, and
the reconunendation of the Director of Public Works, does hereby find
that competitive bidding for the installation of said drainage facility
at Woodlawn Avenue, Flower Street and Riverlawn Avenue is impractical,
and that the work is of urgent necessity for the preservation of life,
health or property, and does therefore authorize that the work may be
let without advertising .for bids, and therefore does hereby waive
formal bidding requirements.
BE IT FURTHER RESOLVED that the Director of Public Works be,
and he is hereby authorized to obtain, by informal bidding, an appro-
priate bid or bids in an amount not to exceed $9,000.00, to be presented
to the Council for acceptance as soon as possible.
BE IT FURTHER RESOLVED that this resolution will require the
affirmative votes of at least four members of the City Council.
