RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, GRANTING THE APPEAL OF DR. A. B. WEINBERG FROM
THE PLANNING COMMISSION ACTION DENYING A CONDITIONAL
USE PERMIT FOR THE USE OF TI-IE PROPERTY AT 453 FOURTH
AVENUE FOR THE OPERATION OF A SINGLE P~:EDICAL OFFICE
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Dr. A. B. Weinberg leas heretofore applied for a
conditional use permit for the use of the property located at 453
Fourth Avenue for a single medical office, and
WHEREAS, the Planning Commission has heretofore held a public
hearing, on September 23, 1968, to consider the request for grant of
such a conditional use permit, and
WIiEREAS, after reviewing all of the evidence and hearing all
of the testimony, the Planning Commission determined that the proposed
location for said medical office did not coincide with the objectives
of the General Plan, would increase traffic congestion on Roosevelt
Street, and would, in essence, be spot zoning, intruding a commercial
use into a residential area, and
WHEREAS, Dr. Weinberg appealed said action of the Planning
Commission denying the conditional use permit, and the City Council
has held a public hearing on said appeal on Tuesday, the 22nd day of
October, 1968, and
tidHEREAS, the City Council finds after hearing all of the
evidence and testimony that said request for a conditional use permit
conforms fully to the findings required by the zoning ordinance of
the City of. Chula Vista, in that such a medical office would be
necessary and desirable in said location, would not create any detri-
mental effect upon the surrounding properties nor materially increase
traffic congestion in the area, and does not conflict with the General
Plan.
NOW, TIIEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista, based upon the findings of fact set forth herein,
does hereby grant the appeal of Dr. A. B. Weinberg from the Planning
Commission action denying said conditional use permit, subject to the
following conditions: (1) a landscaping plan, including the parkway
area adjacent to Roosevelt Street shall be submitted for staff approval
prior to issuance of a building permit; (2) the parkway area along
Fourth Avenue shall be filled with concrete; (3) all signs shall be
staff approved before being placed on the property and their size shall
conform to the R-3 regulations; (4) the parking area shall be screened
by a 3-1/2 foot High block wall adjacent to Roosevelt Street with a
6 foot high bloclc wall required along the easterly property line,
except exclusion from the front setback areas; and (5) the area marked
for future addition shall be landscaped until actual construction starts
on the addition.
