PROBLEIN, TO SECURE APPROPRIATE LEGIS- PP.NSION OF N!ISSION CABLE T.V. CABLE SYSTEMS, IN THE CITY The City Council o.f_ the City o:f Chu1_a. Vista. does hereby_ ,resolve as follows: WHEREAS, the City Council Gf the City Gf Chula Vista has he.retof..ore, on the 23rd day of July, 1968, adopted Resolution t`?o. 4845, stating, among other things: "WHEREAS, recent Supreme Court rulings have established the princir~le that community antenna television systems, Cable T.V., is subject tc the requlat.ion of. the Federal Communications Commission, and "WHEREAS, the Federal Communications Commission has here- tofore ad.opt.ed a decision restricting the expansion of the Mission Cable T.V. Inc, system in the City of Chula Vista, and '"TaHEREAS, the City Council of the City of Chula. Vista has heretofore, by Resolution No. 41.84 adopted September 6, 1966, zegistered a strong protest to said decision as an in.f.rinaement upon the franchise rights o_f the City_ of Chula Vista., and "WHEREAS, in addition to the consistently announced policy of the City of Chula. Vista to pr_ovid_e cable T.V. service to all of the citi_~ens of_ this community, the effect of this decision is even more detrimental to the community welfare because of its adverse and detrimental results regarding the undergroundinq utility program of the City of_ Chula Vista, and "WHFREA.S, if the ruling is not reversed at the present time, al..l purchasers i_n new subdivisions in the City of Chula Vista could be potentially deprived of any _f..uture possibility of cable T.V. service because the ca:?le ser- vice is r_ot underground.ed conc~lrrent with other uti.lities." and said Resolution No. 41.84, adopted on the 6th day of September, 1966 stated, among other things: °°WHEREAS, the initial ruli.nq of the Federal Communications Commission ordering the cable television company to cease and desist from any further connections with its master cable system, and even the subsequent ruling of the L?nited States Court of Appeals modifying the Federal Communica- tions Commission's decision by limiting service to those areas of the City of_ Chula. Vista already covered by the master cable system but z~reventinq the f.urther_ extension into areas not presently covered, abridges the franchise agreement between the City of Chula Vista and. Mission Cable T.V., Inc., and -1- "WHER.EAS, said actions are contrary to the public interest, do not represent any reasonable regulation of the cable television industry, anc7 violate the basic principles of home rule carried out by the elected representatives of the citizens of this com- munity, and "WHER.EAS, said rul.i.ngs are further detrimental to the public interest. of the citizens of the City of. Chula Vista in that all new developments and subdivisions within the City of_ Chula Vista. are reauir_ed by ordinance to place all public utilities underground, which under- around.ing must be carried out in an orderly manner, which cannot be accomplished if television cable cannot be undergrounded concurrent with the undergroundinct of_ other utilities and prior to the completion of public improvements, thus making it impossible to feasibly provide cable T.V. service to such areas in the future if the temporary restrictions imposed by the Commission and the Court a.re changed.. " and. WHEREAS, a conar_essional invest.iaation of cable T.V. has been called. for to provide legislation which ~.aould permit the expansion of_ the cable T.V, system in a manner so as to be compatible with local television broadcasting, and WF?ERF..AS, the City Council of the City of_ Chula Vista strongly supports such legislation. NOW, THEREFORE, BE IT RESOLVED, that the City Council of_ the City of Chula. Vista, on behalf of themselves and all of the citizens of this community, do hereby support the proposal that congressional hearings be held to consider the entire r_able T.V. problem, and urge the 91st Concrress to conduct such hearings and adopt such legislation. BE IT FI?R~'HFR RESOLVED that the City of Chu7_a Vista hereby requests notice o.f said. hearings and an opportunity to appear before the appropriate congressional committee during the course of the hearings. BE IT FURTHER. RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to forward certified copies of this resolution to the legislative delegation of_ San Diego County, and to the Honorable Bob L~?ilson, the Honorable Lionel Van Deerlin, Cong_- aressmen, and to the Honorable C'Teorge Murphy and the Honorable Thomas H.
