RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AUTHORIZING THE MAYOR OF THE CITY OF CHULA VISTA TO APPLY
ON BEHALF OF SAID CITY TO THE PUBLIC UTILITIES COMMISSION
OF THE STATE OF CALIFORNIA FOR A CONTRIBUTION OF ONE-HALF
OF THE CITY'S SHARE IN THE MOSS STREET RAILROAD CROSSING
PROTECTIVE DEVICES
The City Council of_ the City of_ Chula Vista does hereby
resolve as follows:
T~dHEREAS, the City of Chula. Vista, the County of San Diego,
and the San Diego and Arizona Eastern Railway Company have heretofore
agreed to participate in the cost of installing flashing light signals
and automatic gates at the Moss Street F.ailroad Crossing, pursuant to
that certain agreement dated the 30th day of August, 1966, approved
by Resolution No. 4206, and
WHEREAS, the total cost of the installation of. said protective
devices was $11,602.40, and the City's share of said cost under said
agreement was tine sum of $2,900.60, and
WHEREAS, Section 189 of the Streets and Highways Code of
the State of California provides for tlxe establishment by the Public
Utilities Commission of California an annual statewide priority list
of railroad crossings in need of separation, and Sections 190 and
191 of said Code provide .for funds to be allocated to cities in need
of improving grade crossinas on a matching basis.
NOW, THEREFORE, BE IT RESOLVED that the Mayor of the City
of_ Chula Vista be, and he is hereby authorized to apply on behalf of.
the City of Chula Vista to the Public Utilities Commission of tl~e
State of California _f or a contribute"on of one-half of" the City's
share in said installation of protective devices at the Moss Street
Railroad Crossing.

Request of the City of Chula Vista for allocation
from Crossing Protection Fund for protection of_
the intersection of Moss Street and the tracts of
the San Diego and Arizona Eastern Railway Company,
being Crossing No. 30-9.1.
REQUEST FOR ALLOCATION OF FUNDS
TIIE CITY OF CHULA VISTA, State of. California, hereby requests
the Public Utilities Commission to make an allocation to the applicant
from the Crossing Protection Fund in the maximum amount of One Thousand
Four Hundred Fifty and 30/100 Dollars ($1,450.30), such allocation,
however, not to exceed one-half of the actual cost of applicant's share
of the costs of constructing protection at the crossing of the tracks
of the San Diego and Arizona Eastern Railway Company and Moss Street,
being Crossing No. 36-3.1, and in support of said requests submits
the following information;

Attached and marked "Exhibit A" is a true copy of resolution
of the Council of the City of Chula Vista, authorizing the Mayor to
submit this request.

Attached hereto and marked "Exhibit B" is a breakdown of the
total cost of the installation of the protection equipment at the afore-
said crossing.

Attached hereto and marked "Exhibit C" is a true copy of an
agreement between The City of Chula Vista, the County of San Diego, and
the San Diego and Arizona Eastern Railway Company showing by the terms
thereof that the applicant has agreed to contribute one-quarter of the
actual cost of installing said protective equipment.

The protective equipment installed at said crossing under the
terms of said agreement consists of two Standard No. 8 flashing light
signals, supplemented with automatic gates.

Current traffic density at the crossing per actual 16 hour
count is 700 vehicles on a typical weekday. The railroad traffic at
the crossing is 4 moves daily f_or nine months and 6 moves daily for the
remaining three months.

The sum of One Thousand, Four Hundred Fifty and 30/100 Dollars
($1,450.30) herein requested to be allocated does not exceed one-half
of the amount of applicant's share of the total cost of installing said
protective equipment; and applicant proposes to use said One Thousand
Four Hundred Fifty and 30/100 Dollars ($1,450.30) together with sums
from its Capital Outlay Fund for the purpose o.f meeting its obligation
to pay for one-quarter of the total cost of installing said crossing
protection equipment, ire accordance with the terms of the agreement
attached hereto and marked "ExYiibit C°' .

Applicant is informed and believes and therefore alleges
that the files and records of the Public Utilities Commission will
show that Public Utilities Commission Decision No. 70549 required
the installation of said automatic crossing gates and signals at
Moss Street.
G7HEREFORE, Applicant requests an appropriate allocation
from the Crossing Protection Fund.
