RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, APPROVING AGREEMENTS FOR EMERGENCY TOWING
SERVICES WITHIN THE CITY OF CHULA VISTA, AND
AUTHORIZING THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That those certain agreements between the City of Chula
Vista, a municipal corporation, and Charles P. Mote, Arnold's
Garage and Paxton's Garage, to prcvide emergency towing services
within the City of Chula Vista, dated the 4th day of February,
1969, copies of which are attached hereto and incorporated herein
by reference be, and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreements for and on behalf of said City.

good and valuable consideration, receipt of which is hereby acknow-

1. Contractor shall ecrually participate :vith the two other
towing services whose bids are accepted and who a.re awarded a con-
tract, in the exclusive rir~ht to all police recTUested towing in
the City of Chula Vista. Police requested towing shall not include
(a) requests at the instance of motorists for an automobile cub
repres~ntati_ve or a specific tow operator or (b) recuests to tco~
City-o~.rr.ed vehicles
2. Insurance, Contractor shall be insured by an insurance
carrier acceptable tc the City against loss f..rom fire, theft, and
public li_abi_lity and shall file evidence of same -~~ith City. r~Iir_imu:~I

3. Assignment. The Contractor shall not assign this agreement
or any rig:nt or interest hereunder, without the prior written ccn-

~• Hold Harmless. The Contractor shalJ_ assume the defense
of and indemnify and save harmless the City from all claims, loss,
damage, injury and liability of every kind, nature and description,
directly or indirectly arising from the performance of t~"Iis contract.
5. Default. This agreel~~ent ma-r be terminated by the City if

7. Fee Schedule. The f_ee schedule set forth in Resolution

~/ 'v~HEREAS, the City of Chula Vista desires to contract for the
purpose of providing police emergency to~•~ir~g services pursuant to
the provisicns of Sections 31.60, 31.61 and 31.62 of the Chula
Vista City Code and. the policy established by Resolution No, 4192.
NO64, THEREFORE, in consideration of the premises and for other
good and valuable consideratio:., receipt of which i s hereby ackno.~;-
ledged, the parties hereto mutually agree as follos~~s:
1. Contractor shall ec~ua111• participate with the two other
towing services :vhose bids are accepted and ~>>ho are awarded a con-
tract, in the exclusive right to all police requested towing in
the City of Chula Vista. Police requested towing shall not include
(a) requests at the instance of motorists for an automobile club
representative or a specific tow operator or (b} requests to to:a
City-owned ve:~icles.
2. Insurance. Contractor shall be insured by an insurance
carrier acceptable to the City against loss r""rem fire, theft, and
public liability and shall file evidence of same ~,aith City. Minimum
limits of coverage for public liability shall be $250,000.00/
$500,000.00 for oodily injury and $50,000.00 for property damage.
3. Assignment. The Contractor shall not assign this agreement
or any right or in~~erest hereunder, without the prior written con-
sent of the City. An assian.aent without consent cr b~J operation of
law shall automatically terminate this agreement.
~• Hold Harmless. Tine Contractor shall assume the defense
of and indemnify and save harmless the City from all claims, loss,
damage, injury and liability of. every kind, nature and descrintior.,
directly or indirectly arising from the perferrnance of. tx~is contract.
5. Default. This agreement ma;~ be terminated by the City if
the Contractor (a) ceases operations for any reason, or fails or
refuses. to promptly answer police calls for towing service, or (b}
fails to comply r~•it:~r the operati .~g regulations or the fee schedule
as set forth in Resolution No. 41;2 attached hereto and incor~oratec,
herein by reference thereto.
6. Performance. At all tunes during the term tre Contrac~or
shall comply with the eligi'~ility requiremer_ts set forth in Resol-
ution No. 4192. In the event the Contractor fails to compi;• ~~itl-_

7. Fee Schecule. The fee schedule set forth in Resolution

storage of any vehicle not owned by the City.
9. Records. The Contractor shall maintain complete records
of all police requested towing and storage transactions, including
consecutively numaerecl receipts and the same shall be open for
/inspection by the Police Departme.~t and the City Finance Officer
at any reasonable time.
10. Notices. All notices to the Contractor shall be mailed

New 1966 GE two way radio installed in all eauipment. Communications truck
to truck and 21+ hr. AAA operator, for dispatch calls to trucks in field.
All after hours, Sunday and Holidays calls ate through the Southland Cities
Telephone Answering Service. Our own telephone number used 2~ hr. per day
throughout the year.

qualified stand by drivers to put all equipment in services should
emergency require.

Paxton's Garage, 107 Broadway, Chula Vista, has been
providing emergency tow service for the Police
Department since 1948.
Their equipment has been consistently maintained to
meet the highest standards, and the operators employed
have displayed the technical knowledge and ability to
handle towing operations with efficiency and dispatch.
The location of the garage and storage lot is con-
venient to the public and the police, and the facilities
are adequate to provide the security required for police
impounds.
