HomeMy WebLinkAboutReso 1969-5042RESOLUTION N0. 5042 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, AMENDING THAT CERTAIN AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND RICHARD GEORGE WHEELER, A.I.A. AND ASSOCIATES FOR DESIGN OF A POLICE FACILITY The City Council of the City of Chula Vista does hereby resolve as follows: NOW, THEREFORE, BE IT RESOLVED that that certain agreement between the City of Chula Vista and Richard George Wheeler, A.I.A. and Associates for design of a police facility, dated the 5th day of July, 1967, as approved by Resolution No. 4471 adopted on the 5th day of July, 1967 be, and the same is hereby amended in the following respect and in no other: That Article VII, "Architect's Compensation" of said agreement be amended by adding thereto the following paragraph: "In accordance with the Letter of Proposal dated January 2, 1961, signed by W. Gayne Wimer, Vice President, Richard George Wheeler, A.I.A., and Associates, Architect will modify previously approved police facility plans to conform with the Civic Center Master Plan, and City agrees to pay the sum of Three Thousand Dollars ($3,000.00) for such work, which is an estimated maximum cost and which includes labor, overhead, reproductions and rendering. The actual cost shall be fixed by an hourly rate based on the schedule of rates set forth in said Letter of Proposal." BE IT FURTHER RESOLVED that said Letter of Proposal, dated January 2, 1969, attached hereto and incorporated herein by reference be, and the same is hereby approved. BE IT FURTHER RESOLVED that the sum of $3,500.00 be, and the same is hereby appropriated from the unappropriated surplus of the General Fund for the purposes set forth hereinabove. Mr. William Sullins, of the City of Chula Vista, and Messrs. R. G. Wheeler, T. T. Williamson and W. G. Wimer of architects office, it was agreed that I should write a letter in answer to yours of December 16, and to clarify my letter of December 4, 1968. The $3,000 amount reflects our estimate of modifying the pre- viously approved Police Facility plans to conform to the Civic Center Master Plan. The amount is an estimated maximum cost, which includes labor, overhead, reproductions and rendering. The cost, which is an additional charge to the contract we have with the City of Chula Vista, is related to the Police Facility as a separate structure and is not related to any work involving studies or revisions to the Civic Center "Master Plan as proposed by Knight & Gladieux. As soon as the caork that is required for plan revision and site adaptation is complete we wi]_1 revert back to the original architectural agreement. Following Mr. Williamson's meeting with Bruce Warren, we tried several times to arrive at a lump sum fee for services related to the Civic Center Master Plan. We found that we had to make too many assumptions in order to arrive at some idea of the scope of our work. In the interest of both the City of Chula Vista and our office, we propose the work related to the Civic Center Master Plan be done at an hourly rate based on a schedule of rates as follows: .L r~ ~~ ~~zy rcc ~-~~~:~~ /- ~~~ -~ y -1- ~ _-.~~~-~ i - z~-J~ y Mr. Fred A. As outlined briefly above, the Police Facility would be done under a different contract than the work performed on the Civic Center Master Plan. We are proceeding with the work on the Police Facility and have had a recent conference with Chief Winters; however, we would appreciate written authorization from you to proceed with the Police Facility work and the Civic Center Master Plan work.
