L. Searcy $9,907.00 and WHEREAS, it has been recommended that said contract be awarded to Ballard-Williams Cement Company who has assured the City that he is a licensed Contractor ~~ in the State of California and can produce an acceptable performance bond. NOW, THEREFORE, BE IT RESOLVED that the City Counci? of the City of Chula Vista does hereby accept said 4 bids, and does hereby award the contract for said drainage facilities to Ballard-Williams Cement Company to be completed in accordance with the specifications as approved by the Director of Public Works of the City of Chula Vista-. BE IT FURTHER RESOLVED that the sum of $3,500.00 be, and the same is hereby appropriated from the unappropriated surplus of the General Fund for the purpose set forth hereinabove. The Owner will pay the Contractor in current funds for the per- formance of the Contract on the basis of the accepted unit prices and the actual measured quantities of work done at such times as are stated in the Specifications, and will otherwise fulfill its obligations thereunder. 4.
