HomeMy WebLinkAboutReso 1969-5020RESOLUTION NO. 5020 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, GRANTING THE APPEAL OF JOHN HOLZ FROM THE PLANNING COMMISSION DENIAL OF A REQUEST FOR A VARIANCE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commmission of the City of Chula Vista has heretofore held a public hearing on November 18, 1968, to consider the application for a variance from Section 33.16 of the Chula Vista City Code, relating to garage requirements in residential areas, sub- mitted by John Holz for the property located at 972 Nolan Way in the City of Chula Vista, and WHEREAS, the Planning Commission, by a unanimous vote, denied said request for a variance based upon the facts that the garage, as originally constructed, provided sufficient area to park two cars, and that no exceptional circumstances could be found that would justify granting this variance, and WHEREAS, John Holz has filed an appeal from such denial with the City Council, and the Council has held a public hearing on said appeal on December 17, 1968, which hearing was subsequently continued until January 7, 1969. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista that, after fully hearing all evidence submitted on said appeal and considering all testimony presented at said hearing, that said Council does hereby make the following findings of fact: 1. The location of the existing garage and house on the subject property will not allow for the expansion of the garage to serve as a two-car garage or the addition of a two-car carport. 2. The proposed construction will in no way be visible to the public or adjacent property owners and will have no detrimental effect . 3. The proposed remodeling is in no way adverse to the General Plan or the intent of the Zoning Ordinance. BE IT FURTHER RESOLVED that the City Council, based upon said findings, does hereby grant the appeal of John Holz, and that said variance be, and it is hereby granted and the decision of the Planning Commission be, and it is hereby reversed.
