Co e, Director of Public George D.~' indberg, City Attor y Works ADOPTED AND APPROVED by the CITY COUNCIL of the CITY OF` CHULA ViSTA,- CAI~~FORN3A, this 7th ,day of January , 1969 , by the following voteF to-wit: A"YES : Councilmen Scott, Sylvester, Hamilton, McCorquodale, McAllister NAPES: Councilmen None ABSENT; Councilmen None ATTEST' `-.' _ -_1 ..~~.~ ~~ Ci~ty Clerk STATE OF CALIFORNIA i COUNTY OF SAN DIEGO ss~ Cl'TY OF° CHULA VISTA d i® , City Clerk of the City of Chula Vista, CaliforniaF DO HEREBY CERTIFY that the above is a full, true and correct copy of Resolution No, and that the same has not been. amended or repealed DATED /. r F ~ C. ayor o t e City Chula Vi.ata~ City Clerk -~ AGREEMENT AUTHORIZING CONSTRUCTION OF STORM DRAIN FACILITIES BY THE FIRST CHRISTIAN CHURCH THIS AGREEMENT, made and entered into this 31st day of December ,1968, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "City", and THE FIRST CHRISTIAN CHURCH, hereinafter called "Developer"; W I T N E S S E T H WHEREAS, Developer, The First Christian Church, located at 430 Second Avenue in Chula Vista, is desirous of installing storm drain facilities across said property in order to enlarge their parking lot and utilize their property for other church functions, and WHEREAS, Developer will install either a 4 foot by 8 foot box or twin 60 inch reinforced concrete pipes from the west end of the ex- isting reinforced concrete pipe which passes under Second Avenue, and WHEREAS, as a result of said project the existing drainage facility under Second Avenue will also have to be increased in capacity, and WHEREAS, the City Council of the City of Chula Vista has heretofore by Resolution No. 4786 adopted on June 11, 1968, established a policy authorizing the City to participate in the construction of drainage facilities serving a basin of more than 100 acres, and WHEREAS, the City Council on November 5, 1968, indicated its informal approval of participation in said project to the extent of expanding the existing storm drain facilities, and WHEREAS, Developer's project was approved subject to the con- dition that the headwall constructed at the easterly end of the new facilities be designed so as to accommodate the additional pipe for expansion to be constructed by the City at a future date from the eastern terminus of said project. NOW, THEREFORE, IT IS MUTUALLY UNDERSTOOD AND AGREED by and between the parties hereto as follows: 1. Developer, The First Christian Church, agrees to install storm drain facilities across their property from the west end of the existing 60 inch pipe extending easterly under Second Avenue in accord- ance with plans and specifications approved by the City Engineer, which plans shall provide for the design of the headwall at the easterly end of said facility which will accommodate an additional pipe to be con- structed by the City at a future date from said point easterly under Second Avenue. 2. Developer, The First Christian Church, agrees to offer to dedicate a drainage easement across their property of an appropriate width to accommodate the type of drainage facility to be installed. - 1 - ,~- ~c~~~ 3. City agrees to participate in said project to the extent of adding the additional facility required to complete the storm drain facilities from the west end of the existing 60 inch pipe easterly across the parking lot and under Second Avenue. This work would be at no cost to the church and would include resurfacing the disturbed area to the condition existing prior to the excavation. Crsmp~22 City Clerk ,~ s~~~ Chula Vista, California July 3, 1968 Members of the City Council City of Chula Vista The First Christian Church of Chula Vistal located at 430 Second Avenue has long contemplated the feasibility of installing a covered storm drain across the property behind the church, thereby reducing a possible hazard to citizens during periods of storms, as well as eliminating the unsightly natural drainage ditch which exists. Con- current grading and surfacing of the area would also provide an off street parking area for approximately 135 cars. Financial considerations however have del2yed construction, especially since the new Ordinances require either two runs of five foot round the or one of an equivalent capacity. A recent church proposal has been approved by the City Engineer for construction of a rectangular duct which fulfills the requirements of Ordinance ~k1032 regarding capacity to handle a 50 year. storm runoff. Whether or not this improvement can be made in the near future is now dependent upon financing of the project. Current estimates indicate that approximately $20,000 will be required to complete the project either with an open concrete lined ditch or the covered duct (approximately $10,000 duct work plus $10,000 grading and surfacing). A drawing showing the pro- posed work is included herewith. Upon the City Council's adoption and approval of Resolution 4786 on 11 June 1968, it would appear that the project outlined above may be eligible for city participation on a cooperative financial basis. We believe this project will not only improve the property but will benefit the community for the following reasons: (1) It will accept and control drainage of an area which is much greater than that which is owned by the Church. (2) It will prevent weeds and other debris in this immediate area, which ordinarily get into the open drainage channel, from clogging other covered drainage facilities farther on downstream. (3) It will improve the appearance of a sizeable and conspicuous area of the City. ~ ~~, Chula Vista, California July 3, 1968 (4) By making possible a large area for off street parking, it will ease traffic flow along 2nd Avenue which is a major street. (5) It will help the Church to be of greater service in the Community. In view of the above, the Congregation of the church respect- fully requests consideration of cooperative financing of this pro- ject. The church is anxious to proceed as soon as possible. Once the extent of city participation is determined, our financial arrangements will be pursued in anticipation of completing the pro- ject this year. We trust that this request is worthy of your attention and we will be grateful for any participation which you feel would be within city regulations and policy. It requested consideration of cooperative financing concerning the fabrication of a large covered drainage culvert across the church property at 430 Second Avenue. Follow-up correspondance from the City Engineers office indicates that an alternate proposal may be more readily acceptable for city participation. With this in mind the following background information and proposals are submitted. A. Background. Several years ago the city installed one five foot drainage the under second Avenue which would empty upstream runoff onto the church property. The Church extended this 5 ft. t le far enough across the church property to allow for a small parking (©t over the tile, with the intention to extend the t (e all the way across the property whenever financial considerations allowed. In l967 a plan t® proceed with this work was submitted t© the City Engineering Department. A letter was received back stating that a 5 ft. the was no longer considered adequate but that two 5 ft. the wnutd be required if the church -- 5~~ g ~r -2- intended to proceed. Since this would almost double the cost, it was no longer considered feasible to proceed with the project. Upon City Council adoption of Resolution 4786 on June ll, 1968, it appeared that, with a possible 509b participation by the city, it would again be feasible to proceed. My letter of 3 July requested considera- tion of cooperative funding. The matter was referred to the City Engineers office and ( received their letter stating that since there would be no benefit in the church installing two five foot the (or equivalent) part way across the church property they would not recommend cooperative financing unless an additional 5 ft, the was installed under Second Avenue and across the church property to feed the proposed large culvert. This would however require the City to dig up Second Avenue and install the second tile. It would also require the church to add a second 5 ft. the for approximately 75 ft. This will obviously be quite costly to the city as well as the church. B. The church is very desireous of completing the drainage culvert project and is wilting to cooperate with the City in any way financially possible. Sale have made provisions to finance at least ~ of the cost to increase the the size from one 5 ft. tits to two 5 ft. tale on church property and ~ the cost to extend an equivalent capacity culvert the rest of the way across the lot. 11te cannot finance the double size all the way without City participation. In view of the situation as it now stands the church would like to make the following alternate proposals for your consideration. -3- Proposal ~ I. This would be the same as proposal # 1 except that it would postpone expenditure of a considerable amount of City funds until a later date. Current cost to City under this plan would be approximately $5,000.00 based on ~ cost of bids received for installation of the covered culvert. This alternative is what was proposed in my letter of 3 Juty. it would provide a covered drainage path across the entire church property, eliminating the safety hazard and still allowing for increasing `~l `~~l b -4- the size of the remaining part at a later date without serious waste due to the phased installation. It could also mean shifting the major City costs to a later Fiscal years budget. Council consideration of these proposals and approval for cooperative funding for either of them would be appreciated.
