The proposed traffic signal modification project will allow for protected lefr turn movements on all approaches and upgrades the pedestrian signal indications and pushbuttons at the intersection. The proposed resolution, if approved, would award the contract for this project to the low bidder DBX, Inc. in the amount of $182,056.65, waive City Council Policy 574-01, and authorize the expenditure of all available contingency funds in an amount not to exceed $36,411.35. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines because the proposed traffic signal modification work, pedestrian ramp construction and ancillary work involves negligible or no expansion of an existing use. Thus, no further CEQA environmental review is necessary. RECOMMENDATION Council adopt the resolution. 2-1 5/8/2012, Item 2- Page 2 of 3 BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION The traffic signal modification project at the intersection of Second Avenue and "E" Street (CIP No. TF378) was approved for funding in the FY2011-12 Capital Improvement Program. The TF378 project will modify and upgrade the existing traffic signal system at the intersection. Modification work includes providing protected left-turn only phase movements targeted at reducing the frequency of collisions resulting from conflicts associated with left-turn maneuvers and opposing through vehicles. In addition, the project will upgrade the existing pedestrian signal indications, pushbuttons, and all pedestrian ramps at the intersection in accordance with the Americans with Disabilities Act (ADA) standards. On April 11, 2012, the Director of Public Works received six (6) bids as follows: NO. CONTRACTOR TOTAL BID AMOUNT 1 DBX, Inc. -Temecula, CA $182,056.65 2 Lekos Electric, Inc. - El Cajon, CA $191,299.80 3 Select Electric, Inc. -Spring Valley, CA $194,533.00 4 Republic Intelligent Transportation Services, Inc. -Novato, CA $199,000.00 5 HMS Construction, Inc. -Vista, CA $208,676.00 6 Southwest Traffic Signal Service, Inc. -El Cajon, CA $217,882.15 The low bid submitted by DBX, Inc. is below the Engineer's estimate of $187,737 by $5,680, or approximately 3.0%. Staff conducted a detailed check of references provided by the contractor and determined that the contractor has performed their work satisfactorily for those agencies. In addition, DBX, Inc. has satisfactorily performed work for the City of Chula Vista in the past. Staff reviewed the low bid and determined that the bid package is complete, with no errors or omissions. Therefore, staff recommends awarding the contract to DBX, Inc. in the amount of $182,056.65. DBX, Inc. is a licensed General Engineering (Class A) and Electrical (Class C10) Contractor under California License No. 240547. Their license status is current and active per the Department of Consumer Affairs Contractors State License Board. The italicized bid amounts shown for HMS Construction, Inc. and Southwest Traffic Signal Service, Inc. are corrected bid amounts. Both Contractors submitted bids with mathematical errors in their unit to total prices calculations. The grand total bids originally submitted by HMS Construction is $205,088.00 and $218,576.35 by Southwest Traffic Signal Service, Inc.; these errors did not affect the outcome of the bid. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an 2-2 5/8/2012, Item `L Page 3 of 3 individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $5,934.80. Approval of tonight's resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $36,411.35, an increase of $18,205.69 over Policy No. 574-01. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, other unexpected underground conditions, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Disclosure Statement Attachment 1 is a copy of the Contractor's Disclosure Statement. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. CURRENT YEAR FISCAL IMPACT A breakdown of the project costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Base Contract Amount $182,056.65 B. Contin encies (a roximatel 20%) $ 36,411.35 C. Design Support/Survey/Monument Preservation $ 10,000.00 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $253,468.00 Sufficient funds are available in CIP project account TF378. There is no direct fiscal impact to the General Fund as the Transnet funds appropriated in fiscal year 2011/12 provide funding for this project. ONGOING FISCAL IMPACT: Upon completion of the project, annual operating and maintenance cost will decrease due to energy efficiency equipment upgrades. ATTACHMENTS 1. In addition, DBX, Inc. has satisfactorily performed work for the City of Chula Vista in the past; and WHEREAS, staff has reviewed the low bid and recommends awarding a contract to DBX, Inc. of Temecula, California; and WHEREAS, in order to approve change orders as necessary, staff is requesting City Council waive Council Policy No. 574-01. 2-6 Resolution No. Page 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award a contract for the "Traffic Signal Modification at the intersection of Second Avenue and "E" Street (TF378) Project to DBX, Inc. in the amount of $182,056.65; and. BE IT FURTHER RESOLVED, that the City Council of the City of Chula Vista does hereby waive Council Policy 574-01 and authorize the Director of Public Works to approve change orders, as necessary, and expend all available contingency funds in an arp6j~nt not to exceed $37.41135. / / Presented by Richard A.
