HomeMy WebLinkAboutReso 1969-50901 RESOLUTION NO. 5090 RESOLUTION OF THE CITY COUTICIL OF THE CITY OF CHULA VISTA DETERMINING AND DECLARING THE PUBLIC NECESSITY FOR THE ACQUISITION OF CERTAIN REAL PROPERTY IN THE CITY OF CHULA VISTA FOR USE AS A PART OF THE CHULA VISTA CIVIC CENTER COMPLEX AND AUTHORIZING NEGOTIATION WITH SAN DIEGO COUNTY The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS the City Council of the City of Chula Vista has heretofore considered the desirability of acquiring that certain propert-y known as the "F" Street School Site, to be incorporated within the Chula Vista Civic Center complex, bounded on the North by Davidson Street, bounded on the East by Garrett Avenue, bounded on the South by "F" StrE:et and bounded on West by Fourth Avenue, and WHEREAS, the City Council has directed that proceedings be undertaken to acquire said property to be incorporated into said Civic Center Complex, which property is more particularly described in Exhibit "A" attached hereto and made a part hereof by reference. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. That the City Council of the City of Chula Vista finds and determines and hereby declares that the public interest and necessity require the construction of a certain public improvement, namely a par `_ of the Civic Center Complex of the City of Chula Vista upon, over and under that certain real property described in Exhibit "A", attached hereto and made a part hereof by reference. 2. That said real property is necessary therefor, and that such public improvement is planned and located in the manner which will be most compatible with the greatest public good and least possible private injury. 3. That the public interest and necessity require the acquisition in taking over said real property for the purpose of constructing, installing, operating, maa.r;taining, repairing, replacing, and reconstructing portions of the Civic Center Complex of the City of Chula Vista and all structures and land uses incidental and accessory thereto. 4, That the use of all and each and every part of said real property hereinafter described, for the purpose of said construction of a portion of the Civic Center Complex of the City of Chula Vista, is a public use and a use authorized by law, 5. That the acquisition and taking of said real property and of all and each and every part thereof is necessary to such public use and it is necessary that all and each and every part of said real property be so acquired and taken, 6. That the real property referred to hereinabove in this resolution is situated in the City of Chula Vista, County of San Diego, State of California, and is more particularly described in Exhibit "A" attached hereto and made a part hereof by reference. 7. That the Chief Administrative Officer be ar.d he is hereby authorized, empowered and directed to negotiate for the acquisition of said real property, including the employment of an appraiser and to acquire said real property for the purpv:ye of constructing said -1- public improvement and the use of said real property for said public purposes by donation or purchase in accordance with the provisions of the Code of Civil Procedure of the State of Calif- ornia relating to eminent domain.
