RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, MODIFYING THE PROVISIONS OF SECTION 29.2 OF
THE CHULA VISTA CITY CODE WITH RESPECT TO THE FENCING
REQUIREMENTS FOR A SWIMMING POOL LOCATED AT THE
APARTMENT COMPLEX AT 250 BONITA GLEN DRIVE IN THE
CITY OF CHULA VISTA
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Section 29.6 of the Chula Vista City Code grants
authority to the City Council to provide for specific modifications
to those portions of the City Code setting forth the requirements
for swimming pool enclosures and for self-closing and self-latching
gates and doors opening through such enclosures upon the finding of
certain facts, and
WHEREAS, Frank E. Ferreira has made application to the City
Council for modification of the terms of Section 29.2 with respect
to the swimming pool located at the apartment complex at 250 Bonita
Glen Drive in the City of Chula Vista, based upon the following facts:
1. There is no direct entrance from the public street to
the swimming pool area.
2. The swimming pool is completely surrounded by buildings.
3. There are five entrances through breezeways from the
parking lot to the inner court where the swimming pool
is located.
4. The distance from the street to the swimming pool is
approximately 300 feet.
5. The pool is completely surrounded by buildings.
6. The apartment project will be rented to adult tenants
only.
and
WHEREAS, the City Council of the City of Chula Vista has
reviewed the request of Frank E. Ferreira and the reports from the
Building Department of the City of Chula Viita, and concurs with the
recommendations and findings contained therein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that the requirements for fencing of swimming pools
contained in Section 29.2 of the City Code are hereby waived insofar
as the swimming pool located at the apartment complex at 250 Bonita
Glen Drive is concerned, provided that the swimming pool and surrounding
area be well lighted at night, and provided, further, that this exemp-
tion shall be effective only as long as the apartments are restricted
to adult occupancy.
