RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, OPPOSING THE AMENDMENT OF THE BROWN ACT, AS
PROPOSED BY SENATE BILLS NO. 312 AND 314
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Senate Bill No. 312, as proposed, would extend
the provisions of the Brown Act to subcommittees consisting of less
than a quorum of the legislative body, and Senate Bill No. 314 adds
a new section requiring each member of the legislative body attending
an executive session to sign an affidavit under penalty of perjury
that the only matters discussed at the executive session were those
permitted by law, and
WHEREAS, the City Council of the City of Chula Vista has
heretofore gone on record, by Resolution No. 3585, adopted on the
8th day of December, 1964, and by Resolution No. 4749, adopted on
the 7th day of May, 1968, as opposing any amendment to the Brown
Act which would constitute further unnecessary restriction on the
conduct of the public business, and
WHEREAS, the City Council of the City of Chula Vista fully
respects the right of the public to complete information regarding
the conduct of the people's business and has always adhered to the
policy of open and public meetings of the Council and its appointed
boards and commissions, with full disclosure to the public of the
deliberations and actions of said bodies, and
WHEREAS, the present provisions of the Government Code of
the State of California regulating open meetings of local agencies
and proper matters to be discussed in executive sessions of said local
agencies are considered to be more than adequate to insure complete
disclosure to the press and to the public of governmental operations.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Chula Vista does hereby oppose and object to the proposed
amendments of the Brown Act, as set forth in Senate Bills No. 312 and
314, as constituting an unjust and unnecessary interference with the
conduct of the people's business, detrimental to the public interest.
BE IT FURTHER RESOLVED that the City Council of the City
of Chula Vista does hereby reaffirm its belief and adherence to the
policy of open and public meetings of the City Council and of the boards
and commissions of the City, with full disclosure to the public or the
deliberations and actions of said bodies.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and he is hereby directed to forward certified copies
of this resolution to the Legislative Delegation of the County of San
Diego.
