RESOLUTION NO. 5146
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ACCEPTING GRANT OF EASEMENT FROM SANTA FE LAND
IMPROVEMENT COMPANY FOR STREET PURPOSES
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain grant of
easement for street purposes for Tidelands Avenue, executed by SANTA
FE LAND IMPROVEMENT COMPANY, dated the 24th day of February, 1969,
a copy of which is attached hereto and by this reference made a
part hereof, the same as though fully set forth herein be, and
the same is hereby accepted by the City of Chula Vista for street
purposes.
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and he is hereby authorized and directed to forward
a certified copy of this resolution to the Santa Fe Land Improvement
Company, including therewith recording data as to the recordation
of said grant of easement.

California corporation, hereinafter called
flSanta Fe, tt first party, to CITY OF CHUTA VISTA,
a California municipal corporation, hereinafter
called 11city,T1 second art .
Santa Fe hereby donates and grants to City to the
extent of Santa Fels right and interest in the property here-
inafter described, an easement for public street purposes, upon,
over and across that certain strip of land 120 feet in width
by approximately 945 feet in average length in the City of
Chula Vista, County of San Diego, State of California, being a
portion of the southerly half of Quarter Section 172 of the
Rancho de la Nacion according to the map thereof No. 166 filed
in the Office of the County Recozder of said County, which lies
between lines that are parallel and/ or concentric with and
distant 60.00 feet measured at right angles and/or radially
from and on .each side of the following described center lines
' Beginning at the intersection of the
therl line of F Street (80 feet wide)

' with a line that is parallel with and distant
easterly 60.00 feet measured at right angles
from the westerly line of the Southeast
Quarter of said Quarter Section 172; thence.
` South 17°50157.11 East (bearing assumed for
purpose of this description) along said
parallel line 44.44 feet; thence southerly
along the arc of a curve that is tangent to
the preceding course, concave westerly and
.having a radius of 4000800 feet, through a

central angle of 3°2515011 a distance of 239.50
feet; thence South 14°2510711 East, tangent to
the preceding curve, 661.24 feet to a point
of ending in the northerly line of the south-
erly 332 feet of said Quarter Section 172,
The side lines of said strip are to originate
in the southe;-ly line of F Street and are to
terminate in the northerly line of the south-
erly 332 feet of said Quarter Section 172Q
Said strip contains an area of 2p60 acres,
more or less,
EXCEPTING ANI) RESE~,VING the right to be exercised by
Santa Fe and by any others who have obtained, or may obtain,
permission o~~- authority from Santa Fe so to do, (a) to operate,
maintain, renew and/or xelocate any and all existing railros.d
tracks, facilities and appur~enances, wires, pipes and other
facilities of like character upon, over or under the surface
of the iiereinabove described premises; and (b) from time to
time to construct, operate, maintain, zenew and/or relocate
upon said premises additional facilities of the character
described in Clause (a) of this paragraph, without in any
instance being required to obtain the consent of the City,
the same as if this easement had~not been .executed.
TO HAVE AND ~0 HOLD said easement unto City solely
for public street puYposes salong~as the premises hereinabove
described shall be so used, subject, however, to all .licenses,
.leases, restrictions, reservations, conditions,_covenants,
encumbrances, ~ciohts and rights of way, liens and claims of
title and easements which may in anywise affect the said premises,

and subject, also, to the express condition subsequent that if
said premises, or any portion thereof,.shall cease to be used
for the purposes above stated, then and in that event, the ease-
ment hereby given shall, as to such portion or portions, as the
case may be, thereupon cease and determine and Santa Fe, its
successors and assigns, shall resume possession thereof the same
as though this instrument had. not been executed.
This instrument is given without warranty of title of
any kind, express or implied, and no covenant of warranty of title
shall be implied from the use of any word or words herein contained.
In case of the eviction of City by anyone owning or
claiming title to or any interest in the premises hereinabove
described, Santa Fe shall not be liable to City for any damage
of any nature whatsoever,
