HomeMy WebLinkAboutReso 1969-5123RESOLUTION NO. 5123 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA INITIATING RECONSTRUCTION, REMODELING AND CONVERTING UTILITY SERVICES AND ACQUISITION OF NECESSARY RIGHT-OF-WAY FOR THE UNDERGROUNDING OF UTILITIES IN THE UNDERGROUND UTILITY DISTRICT ON "H" STREET FROM THIRD AVENUE TO HILLTOP DRIVE UNDER THE PROVISIONS OF THE IMPROVEMENT ACT OF 1911 AND DIRECT THE CITY ENGINEER TO PREPARE NECESSARY PLANS AND SPECIFICATIONS The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista by Resolution No. 4964 approved on the 11th day of November, 1968, established the "H" Street Underground Utilities District which resolution required that property owners shall have accomplished the work of_ preparing their buildings to accept underground utility service on or before July 1, 1969, and WHEREAS, it is determined that there can be substantial savings if one electrical contractor performs all the work and coordinates the entire program, and WHEREAS, it is recommended that an assessment district in accordance with the Improvement Act of 1911 be established to accomplish this. NOW, THEREFORE, BE IT RESOLVED that the City Engineer be and he is hereby directed to prepare plans, drawings and specifications for the reconstruction, remodeling and converting of existinq utility services in the dwellings of said underground districts to receive underground services in accordance with the requirements of said district and for the purpose of acquiring right-of-way for pad mount transformers, pull boxes and other utility facilities requiring surface easements outside of the existing "H" Street right-of-way within said underground utilities district on "H" Street from Third Avenue on Hilltop Drive in the City of_ Chula Vista together with estimates of the costs and expenses of such work and to furnish this Council with a description of the district and a plat showing the exterior boundaries of the district to be included in the assessment for the work and improvement hereinabove mentioned, said work to be done under the Improvement Act of 1911. BE IT FURTHER RESOLVED that the 1911 Improvement Act proceedings for the conversion of existing utility services as set forth herein shall not be initiated unless and until a petition signed by not less then 20 owners of assessable land at the proposed assessment district, shall have been filed in accordance with the provisions of_ Section 5896.1 et seq, of the Streets and Highways Code. BE IT FURTHER RESOLVED that the City Engineer be and he is hereby directed to make available to all persons within the proposed assessment district, such information as would cause such a petition to be circulated and filed.
