RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZiNG THE EASTLAKE COMPANY
TO CONSTRUCT AND RECEIVE TRANSPORTATION
DEVELOPMENT IMPACT FEE CREDIT AND TRAFFIC
SIGNAL FEE CREDIT FOR A TRAFFIC SIGNAL AT THE
iNTERSECTION OF HUNTE PARKWAY AND CLUBHOUSE
DRIVE, AND AUTHORIZiNG THE PUBLIC WORKS
DIRECTOR TO SIGN THE AGREEMENT WITH THE
EASTLAKE COMPANY, MODIFYiNG THE REQUIREMENT
OF THE MUNICIPAL CODE
WHEREAS, the City received a letter dated September 29, 2000, from the Eastlake
Company requesting authorization to construct, and Transportation Development Impact Fee
credit and Traffic Signal Fee credit for the construction and installation of a traffic signal at the
intersection of Hunte Parkway and Clubhouse Drive; and
WHEREAS, under TDIF ordinance procedures, a developer may request reimbursement
or credit for the construction of facilities identified in the TDIF project list and provides that the
developer may request authorization from the City Council to construct one or more of the
transportation facilities listed in the ordinance; and
WHEREAS, the total cost for construction of Hunte Parkway from Clubhouse Drive to
East Orange Avenue was estimated at $1,250,000.00; and
WHEREAS, the Eastlake Company sought bids from three companies and obtained
qualified bids from two of them; and
WHEREAS, the Eastlake Company submitted an estimate for the construction and thus
staff recommends modification of the Municipal Code requirement of obtaining three bids in
advance of construction; and
WHEREAS, according to Section 3.54.040 of the Chula Vista Municipal Code, the
developer, upon approval of the estimated cost of a project by the Director of Public Works and
receipt of valid bids which have been approved by the Director of Public Works, shall be entitled
to immediate credit for 75 percent of the estimated cost of construction attributable to the
Transportation Facility Project; and
WHEREAS, the Eastlake Company has complied with the procedural requirements of
TDIF ordinance for reimbursement at the 75 percent level for this traffic signal project.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista
does hereby authorize the Eastlake Company to construct and receive Transportation
Development Impact Fee credit and Traffic Signal Fee credit for a traffic signal at the
intersection of Hunte Parkway and Clubhouse Drive.
BE IT FURTHER RESOLVED that the Public Works Director is hereby authorized to
sign the agreement with the Eastlake Company modifying the requirement of the Municipal
Code for three bids.
