RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
GRANTING A SEWER SERVICE CHARGE VARIANCE TO MR. & MRS.
WILLIAM R. HOLLAND FOR A WATER METER USED EXCLUSIVELY FOR
IRRIGATION PURPOSES
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Mr. & Mrs. William R. Holland, of 4105 Camino Del
Cerro Grande, have applied for a sewer service charge variance for the
water meter serving the property located at 4065 Camino Elevado in the
City of Chula Vista, and
WHEREAS, the application for said exemption from the sewer
service charge for said meter has been reviewed by the Board comprised
of the Chief Administrative Officer, the Director of Public Works and
the Finance Officer of the City of. Chula Vista, pursuant to the pro-
visions of Ordinance No. 807 and the Rules of_ Interpretation and Pro-
cedure for Administration of Requests for Variance from Sewer Service
Charges, and
WHEREAS, said review indicated that the meter in question. is
located on a vacant lot, and is used exclusively for the irrigation and
watering of street trees, and does not require or utilize sewer services.
NOW, THEREFORE, HE IT RESOLVED by the City Council of the
City of Chula Vista that based upon the above findings of fact, the
subject meter shall be exempt from the payment of sewer service charges
until such time as a dwelling unit or other structure utilizing sewage
facilities is erected on the property located at 4065 Camino Elevado,
pursuant to the provisions of Section 26.82, subsections (a) and (b) of
the City Code.
BE IT FURTHER RESOLVED that the sewer service charges billed
to said meeter for December 1967 and subsequent months to date be, and
the same are hereby authorized to be refunded.
BE IT FURTHER RESOLVED that the California Water and Telephone
Company be notified that such exemption shall be considered effective
upon all billings from December 1967 to and including such time as a
building or structure utilizing sewage facilities is erected on said
property, or until such exemption is rescinded by the City Council of
the City of Chula Vista.
