RESOLUTION N0. 4749 RESOLUTION OF THE CITY COUNCIL OF TI3E CITY OF CHULA VISTA OPPOSING THE AMENDMENT OF THE BROtiti'N ACT, AS PROPOSED BY ASSEMBLY BILL NO. 202 The City Council of the City of Chula Vista does hereby resolve as follows: W~IEREAS, Assembly Bill No. 202 was approved by the Assembly Committee on Government Organization on March 19, 1968, wYlich bill provides for the following addition to the Ralph A4. Brown Act: "As used in this chapter, "legislative body" also includes, but is not limited to, any advisory agency, board, commis-ion, committee or other advisory body of a local agency, created by charter, ordinance, resolution, adoption of a motion, or by any other action of the local agency, and where public funds, facilities, ecxuipment, materials, supplies or per- sonnel are used in connection with tre work of such advisory body." and WHEREAS, the City Council of the City of_ Chula Vista has heretofore gone on record opposing any amendment to the Brown Act which would constitute further unnecessary restriction on the conduct of the public business, as expressed in Resolution No. 3585, as follows: "WHEREAS, the City Council of the City of Chula Vista fully respects the right of the public to complete infor- mation regarding the conduct of the people's business and has always adhered to the policy of open and public meet- ings of the Council and Committees with full disclosure to the public of the deliberations and actions of said bodies, and "WHEREAS, the present provision of the Government Code of the State of California regulating open meetings of local agencies is considered more than adequate to insure com- plete disclosure to the press and to the public of govern- mental operations, and" WHEREAS, the proposed amendment to the Brown Act contained in Assembly Bill 202 would create an intolerable and unnecessary burden upon the many advisory bodies and committees meeting for single or limited purposes. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby oppose and object to the amendment of the Ralph M. Brown Act, as proposed by Assembly Bill No. 202, as con- stituting an unjust and unnecessary interference with the conduct of the people's business, detrimental to the public interest. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby reaffirm its belief and adherence to the policy of open and public meetings of the City Council and of the boards and commissions of the City, with full disclosure to the public of the deliberations and actions of said bodies. BE IT FURTHER RESOLVED that the City Clerk of the City of Chula Vista be, and he is hereby directed to forward certified copies of this resolution to the Legislative Delegation of the County of San Diego.
