HomeMy WebLinkAboutReso 1968-4742 RESOLUTION N0, 4742 RESOLUTIONd OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA SUPPORTING THE SOUTH BAY IRRIGATION DISTRICT IN Ti3E EFFORT TO ACCOr1PLISH PUBLIC OWNERSHIP OF THE SWEETWATER DIVISION WATER SUPPLY AND DISTRIBUTION FACILITIES OF T'r3E CALIFORNIA- AMERICAN WATEF. COMPANY The City Council of the City of Chula Vista does hereby resolve as follows: 6dHEREAS, studies, analyses and reports and financial consultants have demonstrated that interests of the water consumers of the Sweetwat American Water Company and its predecessors that water supply and distribution facilities o.f said operated by a public agency or agencies; and by independent engineering it would be to the best ~r Division of the Ca.liforni the Sweetwater Division Company be acquired and WHEREAS, if the acquisition of said facilities is financed by revenue bonds, both the benefits and the cost of acquisition will inure to the water consumers and will net affect the tax rate; and 6vHEREAS, the South Bay Irrigation District includes within its boundaries all of the service area of said Sweetwater Division, except the portion located within the City of National City; and WHEREAS, all of the service area of said Division located within the City of Chula Vista is located within the boundaries of the South Bay Irrigation District; and WHEREAS, the South Bay Irrigation District is an appropriate public agency to accomplish public ownership of_ said facilities; and WHEREAS, such desirable result for the water consumers of the City of Chula Vista can be accomplished either through a Joint Powers Agreement between South Bay and National City or by the action of the Souttl Bay Irrigation District in acquiring all of said facilities by eminent domain proceedings or negotiations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. The City Council of the City of Chula Vista hereby supports the principle that public ownership of the water supply and distribution facilities of the Sweetwater Division of the California-American Water Company is in the best interests of the water consumers of the City of Chula Vista; 2. The Soutll Bay Irrigation District is hereby urged to take such steps as may be necessary to accomplish with reasonable dispatch public ownership of said facilities by means of revenue bonds; 3. If a reasonable and equitable agreement, similar in principle to the "Joint Powers Agreement of 1967", cannot be accomplished between the South Bay Irrigation District and the City of National City, the South Bay Irrigation District is urged to proceed with such other steps as are necessary to acquire said Sweetwater Division in its entirety; -1- 4. That the support of the Chula Vista City Council is under- taken based upon the findings and recommendations of the report of the Engineering Firm of Leeds, Hill and Jewett, Inc., dated August 31, 1967, and it is urged that public ownership of said facilities be accomplished in accordance with said findings and conclusions.
