RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA,
CALIFORNIA, RECITING THE FACT OF THE GENERAL ELECTION HELD
IN SAID CITY ON THE 9TH DAY OF APRIL, 1968, DECLARING THE
RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW
The City Council of_ the City of Chula Vista does hereby resolve
as follows:
tivHEREAS, a regular general municipal election was held and
conducted in the City of Chula Vista, County of San Diego, State of
California, on Tuesday, tYie 9th day of April, 1968, as required by law,
and
WHEREAS, notice of said election was duly and regularly given
in time, form and manner as provided by law; that voting precincts were
properly established; that election officers were appointed, and that
in all respects said election was held and conducted and the votes cast
thereat, received and canvassed and the returns made and declared in
time, form and manner as required by the provisions of the Elections
Code of the State of California for the holding of elections in general
law cities, and ~'
WHEREAS, the returns of said election have been duly and
regularly canvassed as provided by law, and all absentee ballots, if any,
returned have been canvassed as provided by law.
NOL9, THEREFORE, BE IT RESOLVED by the City Council of the City
of Chula Vista as follows:
Section 1. That there were sixty (60) voting precincts estab-
lished for the purpose of. holding said election consisting of. consolida-
tions of_ the regular election precincts in the City of Chula Vista, the
Chula Vista City School District and the Sweetwater Junior College District
as established for the holding of state and county elections.
Section 2. That said regular general municipal election was
held for the purpose o.f_ electing the following officers of said City and
City School District as required by laws relating to general law cities
in the State of California, to-wit:
One (1) Mayor of the City of Chula Vista for a full term of
four (4) years;
Two (2) Members of the City Council for a full term of four(4)
years;
Three (3) Members of the Board of Education of the Chula Vista
School District for a full term of four (4) years.
Section 3. That at said regular general municipal election,
the following measures were submitted to the electors of said City, to-wit:
PROPOSITION A
Shall the City Council of the City of Chula Vista adopt an ordinance
authorizing said city to enter into a joint powers agreement with the
County of San Diego f.or the purpose of establishing a public authority
which shall have the power to acquire, construct, maintain, and operate
a community hospital and related facilities, and the financing thereof?

PROPOSITION B
Amend Article III, Section 302 thereof, of the Charter of the City of
Chula Vista to be and to read as follows:
Section 302. Compensation for Councilmen.
The Councilmen of the City Council shall receive, as compensation
for their services, the amount authorized under State law for council-
men of general law and charter cities, in accordance with the schedule
established by such State law provisions, upon the enactment of the
necessary ordinance providing for such salary, and shall receive reim-
bursement on order of the City Council for Council-authorized traveling
and other expenses when on o.f_ficial duty out of the City. In addition,
each Councilman shall receive the sum of FIFTY DOLLARS ($50.00) per
month which amount shall be deemed to be reimbursement of other out-of-
pocket expenditures and costs imposed upon him in serving as a City
Councilman. The City Council may also provide, by resolution, for tree
payment to the Councilmen of an allowance or a sum certain per month,
to reimburse them for the additional demands and expenses made upon and
incurred by them in serving as Councilmen.
PROPOSITION C
Amend Article V, Section 503 thereof, of the Charter of the City of
Chula Vista to be and to read as follows:
Section 503. City Attorney. Powers and Duties.
To become eligible f.or City Attorney, the person appointed shall be
an attorney-at-law duly licensed as suciz under the laws of the State of
California. The City Attorney shall have power and be required to:
(a) Represent and advise the City Council and all city officers in
all matters of law pertaining to their offices;
(b) Represent and appear for the City and any city officer or em-
ployee, or former city officer or employee, in any or all actions and
proceedings in which the City or any such officer or employee in or by
reasons of his official capacity, is concerned or is a party;
(c) Attend all regular meetings of the City Council and give his
advice or opinion in writing whenever requested to do so by the City
Council or by any of the boards or officers of the City;
(d) Approve the .form of all contracts made by and all bonds given
to the City, endorsing his approval thereon in writing;
(e) Prepare any and all proposed ordinances or resolutions for the
City, and amendments thereto;
(f) Prosecute, if so directed by ordinance of the City Council, all
offenses against the ordinances of the City and for such offenses against
the laws of the State as may be required of. him by law, and shall have
concurrent jurisdiction with the District Attorney of the County of
San Diego to prosecute persons charged with or guilty of the violation
of the State laws occurring within the City limits of the City of Chula
Vista for offenses constituting misdemeanors;
(g) Devote such time to the duties of his office as may be specified
in the ordinance or resolution fixing the compensation for such office;
and
(2z) Surrender to his successor all books, papers, files and documents
pertaining to the City's affairs.
The City Council shall have control of all legal business and pro-
ceedings and may employ other attorneys to take charge of any litigation
or matter or to assist the City Attorney therein.
PROPOSITION D
Amend Article VI, Section 612 thereof, and delete Section 615, amend
Article VIII, Sections 801 and 802 thereof, amend Article V, Section
500, and delete Section 504 of the Charter of the City of Chula Vista
to be and to read as follows:

Section 612. Civil Service Commission. Powers and Duties.
The Civil Service Commission shall have power and be required to:
(a) Recommend to the City Council, after a public hearing thereof,
the adoption, amendment or repeal of civil service rules and regulations
not in conflict with this Article;
(b) Hear appeals of_ any person in the Classified Service relative tc
any suspension, demotion or dismissa]_; and
(c) Make recommendations to the City Council on compensation being
paid for each class of position under the Classified Service and hourly
part-time classes and of hours of labor, sick leaves and vacations
applicable to each such class, at least once a year and at such other
time as -the City Council may request. Such recommendations may include:
Comparisons with rates of pay for comparable service in commercial
and industrial establishments and in other public employment;
Surveys of prevailing market rates, costs and standards of living
and of the City's policies, finances and means with respect to the
Classified Service;
(d) Make any investigation which it may consider desirable concern-
ing the administration of_ personnel in the municipal service and report
its findings to the City Council and Administrative Officer.
Section 615. Harbor Commission. DELETE
Section 801. Unclassified and Classified Service.
The Civil .Service of the City shall be divided into the Unclassified
and the Classified Service.
(a) Unclassified Service. The Unclassified Service shall include
the following officers and positions:
1. All elective officers;
2. Administrative Officer, Finance Officer, City Attorney, and
one private secretary to the Administrative Officer;
3. All members of boards and commissions;
4. Positions in any class or grade created for a special or
temporary purpose and which may exist for a period of not more than
ninety days in any one calendar year;
5. Persons employed to render professional, scientific, technical
or expert service of an occasional and exceptional character; and
6. Part-time employees paid on an hourly or per diem basis.
(b) Classified Service. The Classified Service shall comprise all
positions not specifically included by this Section in the Unclassified
Service.
(c) Any person holding a position or employment included in the
Classified Service who, on the effective date of this Charter, shall
have served continuously in such position, or in some other_ position
included in the Classified Service, for a period of six months immediately
prior to such effective date, shall automatically be granted regular status
in the Classified Service in the position held on such effective date,
without preliminary examinations or other tests, and shall thereafter be
subject in all respects to the provisions of the Civil Service system
provided for in this Charter.
Any person holding such a position or employment who, on the effective
date of this Charter, shall have served in the Classified Service for a
period of less than six months immediately prior to such effective date
shall automatically be granted the status of a probationary appointee in
the position held on such effective date, without preliminary examinations
or other tests, and the length of his service in the position shall be
credited to his probationary period as provided for in this Article.
(d) The person holding the position of Librarian, an Unclassified
position prior to the effective date of this amendment, if he shall
have served continuously in such position for the period of six months
immediately prior to such effective date, shall assume regular status
in the Classified Service in said position.
Section 802. Appointment and Duties of Personnel Clerk. DELETE

Section 500. Officers to be Appointed by the City Council.
In addition to the Administrative Officer, there shall be a City
Attorney and a City Clerk who shall be appointed by and serve at the
pleasure of the City Council.
Subject to the civil service provisions of this Charter all other
officers and department heads of the City shall be appointed by the
Administrative Officer subject to the approval of the City Council.
Section 504. City Judge. DELETE
PROPOSITION E
Amend Article XI, Section 1109 thereof, of the Charter of the City of
Chula Vista to be and to read as follows:
Section 1109. Contracts on Public 6Vorks.
Every project involving an expenditure of three thousand dollars or
more for the construction, reconstruction, improvement or repair of
public buildings, streets, drains, sewers, utilities, parks and play-
grounds, and other public works, and the furnishing of supplies,
materials, equipment or contractual services for same shall be done
by written contract except as otherwise provided in this Charter, and
the Council, upon the recommendation of the Administrative Officer, shall
let said contract to the lowest responsible bidder after notice by pub-
lication in the official newspaper for sealed bids for the work con-
templated by one or more insertions, the first of which shall be at
least ten days before the time for opening bids. If the cost of said
public works project is more than the sum of one thousand dollars but
less than three thousand dollars, the City Council may let said contract
without advertising for bids after the Administrative Officer or his
designated agent has secured competitive prices from interested con-
tractors, which shall be considered by the Council before said contract
is let.
The City Council may, however, declare and determine that in its
opinion, based upon estimates approved by, and the recommendations of,
the Administrative Officer, that said projects may be excepted from the
requirements of this section because the work in question may be per-
formed better or more economically by the City with its own employees,
and by a resolution to this effect, adopted by at least four affirmative
votes of the Council, order_ the performance of_ any such construction,
reconstruction, improvement or repair by appropriate City force.
All bids, of more than one thousand dollars, shall be accompanied by
either a certified, or cashier's check, or a bidder's bond executed by
a corporate surety authorized to engage in such business in California,
made payable to the City. Such security shall be in an amount not less
than that specified in the notice inviting bids or in the specifications
referred to therein, or if no amount be so specified then in an amount
not less than ten percent o.f the aggregate amount of the bid. If the
successful bidder neglects or refuses to enter into the contract, within
the time specified in the notice inviting bids or specifications referred
to therein, the amount of his bidder's security shall be declared for-
feited to the City and shall be collected and paid into its general fund
and all bonds so forfeited shall be prosecuted and the amount thereof
collected and paid into such fund.
The City Council shall be competent in awarding any contract to com-
pare bids on the basis of time completion, provided that when any award
has been made in consideration, in whole or in part, of the relative
time estimates of bidders for the completion of the work, the performance
in accordance with such time limits shall be secured by a surety bond as
hereinabove provided with adequate sureties and penalties, and provided
further, that for any contract awarded solely or partially on a specified

time for completion, the Council shall not extend such time limits un-
less such extension be recommended by the Administrative Officer and the
head of the department concerned.
The City Council may reject any and all bids presented and may re-
advertise in its discretion.
Contracts may likewise be let without advertising for bids if such
work shall be deemed by the City Council to be of urgent necessity for
the preservation of life, health or property, and shall be authorized
by resolution passed by at least four affirmative votes of the Council
and containing a declaration of the facts constituting such urgency;
provided, however, that nothing in this section shall prevent the
Administrative Officer from taking any and all means necessary to make
emergency repairs in the event of immediate need arising from any
calamity or disaster.
PROPOSITION F
Amend Article VI, Section 613 thereof, of the Charter of the City of
Chula Vista to be and to read as follows:
Section 613. Parks and Recreation Commission.
There shall be a Parks and Recreation Commission consisting of at
least five members to be appointed by the City Council from the qualified
electors of the City and no members of said Commission shall hold any
paid office or employment in the City government. The number of members
to comprise the Commission may be changed by ordinance of the City
Council.
In the event the City Council contracts with other agencies inter-
ested in recreation and parks for the joint exercise o.f any of such
functions, such contract may provide for representation on the Commis-
sion of representatives of such agencies during the existence of such
contract or extensions thereof..
PROPOSITION G
Amend Article VII, Section 809 thereof, and delete Section 810 of the
Charter of the City of Chula Vista to be and to read as follows:
Section 809. Improper Political Activity.
No elective or appointive officer or employee of the City of Chula
Vista, whether employed in the classified or unclassified service, shall:
(a) Directly or indirectly use, promise, threaten or_ attempt to use
any official influence in aid of any partisan political activity, or to
affect the result of any election to partisan or political office or
upon any other corrupt condition or consideration;
(b) Solicit or coerce from any other officer or employee of the
City of Chula Vista any political assessment, subscription or contribu-
tion;
(c) Engage in any political activity while in the uniform prescribed
for any officer or employee of the City of Chula Vista or during any
hours in which he has been directed to perform his assigned duties;
(d) Become a candidate or accept the nomination to the office of
Mayor or Councilman if he is appointed by the City Council without
first resigning his position, except that no such officer or employee
who becomes a candidate for .Council need resign if the incumbents do
not become candidates for such offices in that election.

Nothing in this Article shall be construed to prevent any such officer
or employee from becoming or continuing to be a member of a political
club or organization, or from attendance at a political meeting, or
from enjoying entire freedom from all interference in casting his or
her vote or from seeking or accepting election or appointment to public
office.
Any willful violation thereof or violation through culpable negligence
shall be sufficient grounds to authorize the discharge of an officer or
employee
No person in the Classified Service, or seeking admission thereto,
shall be employed, promoted, demoted or discharged, or in any way favored
or discriminated against because of political opinions or affiliations
or because of race or religious belief, except that no one shall be
eligible to hold a position with this City who advocates the overthrow
of our form of government key force or violence.
Section 810. Solicitation of Contributions. DELETE
PROPOSITION H
Amend Article V, Section 513 thereof, of the Charter of the City of
Chula Vista to be and to read as follows:
Section 513. Oath of Office.
Each member of the City Council a.nd of every board and commission
and each officer, department head and full-time employee, before enter-
ing upon the discharge of the duties of his office, shall take, sub-
scribe to and file with the City Clerk the following oath or affirma-
tion:
"I do solemnly swear (or affirm, as the case may be) that I will
support the Constitution of the United States and the Constitution
of the State of California; that I will, in all respects, observe
the provisions of this Charter and the ordinances of the City of
Chula Vista; that I will faithfully discharge the duties of the
office of (here inserting name of office) according to the best of
my ability; and that I do not advocate the overthrow of the govern-
ment of the United States by force or violence."
Section 4. That at said regular general municipal election the
following measures were submitted to the electors of the Chula Vista
City School District, to-wit:
MAXIMUM TAX RATE:
Shall the existing maximum tax rate of $1.90 be continued in the
Chula Vista City School District for the school years 1968-69
through 1975-76, inclusive, the revenues of which are to be used
to provide and maintain an adequate educational program?

Section 5. That at said regular general municipal election
the following measures were submitted to the electors of the Sweetwater
Junior 'College District, to-wit:
MAXIMUM TAX RATE:
Shall the proposed increase in the maximum tax rate from $ .35
to $ .65, such rate to be in effect in the Sweetwater Junior
College District for the school years 1968-69 through 1972-73,
inclusive, the revenues of which are to be used to provide
and. maintain an adequate educational program, be authorized?
Section 6. That the whole number of votes cast in said City
(except absent voter ballots) was 14,164 and that the whole number
of absent voter ballots cast in said City was 390 makinq a total o.f
14,554 votes cast in said City.
Section 7. That the names of persons voted for at said election
for Mayor of the City of Chula Vista are as follows:

and
That the names of persons voted for at said election

as set forth hereinabove, and
That the number of votes given at each precinct and
the number of votes given in the City to each of such persons above named
for the respective offices for which said persons were candidates and for
and against the measures set forth herein were as shown in Exhibit "A"
attached hereto and made a part hereof by reference.
Section 8. That the City Council does declare and determine
that
Daniel A. McCorquodale was elected Mayor of the City of
Chula Vista for the full term of four years;

Thomas (Tom) Hamilton, Jr. was elected as Member of the City
Council of said City for the full term of four years;
Frank A. Scott was elected as Member of the City Council of
said City for the full term of four years;
Hazel Goes Cook was elected as a Member of tree Board of Educa-
tion for the Chula Vista City School District for the full
term of four years;
Ralph E. Schrock was elected as a Member of the Board of Educa-
tion for said. school district for the full term of four years;
Edward A. Kemler was elected as a Member of the Board of Educa-
tion for said school district for the full term of four years.
and
That as a result of said election, a majority of
the qualified voters voting or. Propositions "B" "C" "D" "E" "F" "G"
and "H" relating to Charter changes did vote in favor thereof, and~that
said propositions carried, and shall be deemed adopted and ratified, and
That as a result of said election, a majority of
the qualified voters voting on Proposition "A" relating to the Community
Hospital Public Authority did not vote in favor thereof, and that said
proposition was not carried, and shall not be deemed adopted and ratified,
and
That as a result of said election, a majority of
the qualified voters voting on the measure relating to the Maximum Tax
Rate for the Chula Vista City School District did vote in favor thereof,
and that said measure carried and shall be deemed adopted and ratified.
That as a result of said election, a majority of
the qualified voters voting on the measure relating to the Maximum Tax
Rate for the Sweetwater Junior College District did vote in favor thereof,
and that said measure carried and shall be deemed adopted and ratified.
Section 9. That the City Clerk shall enter on the records of
the City Council of said City, a statement of the results of said election
showincr
(1) The whole number of votes cast in the City,
and the Chula Vista City School District,
and the Sweetwater Junior College District;
(2) The names of the persons voted for;
(3) The propositions and measures voted upon;
(4) The office for which each person was voted for;
(5) The number of votes given at each precinct to
each person and for and against each proposition
and measure;
(6) The number of votes given in the City, the City
School District, and the Sweetwater Junior
College District to each person and for and
against each proposition and measure.
Section 10. That the City Clerk shall immediately make and,
upon compliance by the persons elected with the pro~tisions of Sections
11565 and 11568 of the Elections Code of_ the State of California, shall
deliver to each of such persons so elected a Certificate of Election,
signed by him and duly authenticated; that he shall also administer to

each person elected the Oath of Office prescribed in the State Constitution
of the State of California and shall have them subscribe thereto and file
the same in his office. He shall also require from each of such respec-
tive persons so elected the required loyalty oath and file the same in
his office. Whereupon, each and all of said persons so elected shall be
inducted into the respective office to which they have been elected.
Section 11. That the City Clerk shall certify to the passage
and adoption of this resolution; shall enter the same in the Book of
Original Resolutions of said City, and shall make a minute of the passage
and adoption thereof in the records of the proceedings of the City Council
of the City of Chula Vista in the minutes of the meeting at which the
same is passed and adopted.
